HomeMy WebLinkAboutR-11-0209City of Miami Legislation Resolution: R-11-0209 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00418a Final Action Date: 5/12/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER AND CITY ATTORNEY TO WITHDRAW THE ALTERNATE CORRIDOR FILED ON MAY 2, 2011, AND TAKE ANY AND ALL ACTIONS NECESSARY TO PREVENT FLORIDA POWER AND LIGHT FROM PLACING [OVERHEAD] TRANSMISSION LINES THROUGH THE CITY OF MIAMI, UNLESS UNDERGROUNDED, IN THE MATTER OF FLORIDA POWER AND LIGHT COMPANY, TURKEY POINT UNITS 6 AND 7 POWER PLANT SITING APPLICATION, CASE NO. 09-003575EPP; IN ADDITION TO LOOKING INTO ANY POSSIBLE REVOCATION AND/OR SUSPENSION OF SITE CERTIFICATION. WHEREAS, Florida Power and Light ("FPL") desires to place overhead high voltage transmission lines through the City of Miami, ("City") specifically on US 1 between Turkey Point and Downtown Miami, Florida; and WHEREAS, several neighboring cities have proposed an alternate corridor through the areas of Flagami and Allapatah within the City; and WHEREAS, many experts say transmission lines can be safely placed underground; and WHEREAS, the proposed FPL corridor and alternate corridor for the overhead transmission lines will negatively impact the densely populated City, including residents, businesses, quality of life, and public health, along the routes; and WHEREAS, many experts claim overhead transmission lines may be dangerous to the public due to the electromagnetic fields surrounding the lines; and WHEREAS, members of the public and citizen groups in the City of Miami oppose the transmission lines, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager and City Attorney are directed to withdraw the alternate corridor and take any and all action necessary to prevent Florida Power and Light Company from placing [overhead] transmission lines through the City of Miami, unless undergrounded, in the City of Miami Page 1 of 2 File Id: 11-00418a (Version: 1) Printed On: 10/6/2017 File Number: 11-00418a Enactment Number: R-11-0209 matter of Florida Power and Light Company Turkey Point Units 6 and 7 Power Plant Siting Application, CASE NO. 09-003575EPP; in addition to looking into any possible revocation and/or suspension of site certification. Section 3. This Resolution shall become effective immediately upon its adoption and signature by the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, It shall become effective immediately upon override of the veto by the City Commission.
