A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE
MEMBER AGENCIES OF THE CHILD ABDUCTION RESPONSE TEAM AND THE
FLORIDA DEPARTMENT OF LAW ENFORCEMENT, FOR AN ADDITIONAL
PERIOD FROM JANUARY 1, 2011 THROUGH DECEMBER 31, 2012, TO
CONTINUE TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF LAW
ENFORCEMENT SERVICES AND RESOURCES TO ADEQUATELY RESPOND TO
CONTINUING, MULTI -JURISDICTIONAL INVESTIGATIONS OF CHILD
ENDANGERMENTAND MISSING/ABDUCTED CHILDREN, SO AS TO PROTECT
THE PUBLIC PEACE AND SAFETY, AND PRESERVE THE LIVES AND
PROPERTY OF THE CITIZENS, AS DEFINED IN PART 1, CHAPTER 23, FLORIDA
STATUTES.
WHEREAS, the subscribed law enforcement agencies have joined together in a
multi -jurisdictional effort to rescue abducted children and under circumstances allocate their resources
to missing/endangered children cases; and
WHEREAS,"these agencies are all participants in a multi -agency effort known collectively as
the Children Abduction Response Team ("CART"); and
WHEREAS, these agencies agree to utilize applicable state and federal laws to prosecute
criminal, civil, and forfeiture actions against identified violators, as appropriate; and
WHEREAS, these agencies have the authority under Part 1, Chapter 23, Florida Statutes, "the
Florida Mutual Aid Act," to enter into a voluntary agreement for cooperation and assistance of a routine
law enforcement nature that crosses jurisdictional lines; and

that it is to the advantage of each to receive and extend mutual aid in the form of law enforcement
services and resources to adequately respond to continuing, multi -jurisdictional criminal activity, so as
to protect the public peace and safety, and preserve the lives and property of the citizens; and
WHEREAS, additional parties, at the request and with the approval of Florida Department of
Law Enforcement ("FDLE") and other Child Abduction Team members, enter into this Agreement at a
later date as evidenced by their signing of the Agreement;
NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.

Section 2. The City Manager is authorized{1 } to execute a Mutual Aid Agreement, in
substantially the attached form, between the member agencies of CART and FDLE, for an additional
period from January 1, 2011 through December 31, 2012, to continue to receive and extend mutual aid
in the form of law enforcement services and resources to adequately respond to continuing,
multi -jurisdictional investigations of child abduction and missing/endangered children, so as to protect
the public peace and safety, and preserve the lives and property of the citizens, as defined under Part
1, Chapter 23, Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution,
it shall become effective immediately upon override of the veto by the City Commission.
