A RESOLUTION OF THE MIAMI CITY COMMISSION, PURSUANT TO SECTION
62-521(B) (4) AND (5), OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, WAIVING THE TEMPORARY EVENT, TWO (2) EVENT LIMITATION
PER PROPERTY PER YEAR PERMIT, IN ORDER TO HOST AN OPEN AIR RETAIL,
PLACE OF ASSEMBLY, AND RECREATIONAL ESTABLISHMENT FROM MAY 1,
2011 THROUGH APRIL 30, 2014, AS STATED HEREIN.
WHEREAS, the Omni Park West Redevelopment Association, Inc., a 501(c)(3) Florida
not -for -profit corporation with its principle offices located at 697 North Miami Avenue, Loft #2, Miami,
Florida ("OPWRA"), wishes to host temporary events incorporating an Open Air Retail, Place of
Outdoor Assembly, and Recreational Establishment at Grand Central Park, located at 721 Northwest
1 Avenue, Miami, Florida, beginning May 1, 2011 and ending on April 30, 2014; and
WHEREAS, Grand Central Park is a pilot park project by OPWRA to enhance quality of life in the
Park West neighborhood of Downtown Miami by beautifying 4.71-acres of blighted land in order to
create a public park space that is pedestrian -friendly, environmentally -friendly and brings economic
activity through open air markets and outdoor events ("Park"); and
WHEREAS, on January 31, 2011, the Southeast Overtown Park West Community
Redevelopment Agency Board approved a $200,000 grant for Grand Central Park contemplating
OPWRA's permit application and requiring the Park to be open and operating for a minimum duration
of three (3) years; and
WHEREAS, pursuant to Section 62-521, of the Code of the City of Miami, Florida, as amended
("City Code"), the City Commission regulates the use of Temporary Events to no more than two (2)
events per year per property, for no longer than two (2) weeks each; and
WHEREAS, pursuant to Section 62-521 (b) (4) and (5), of the City Code, said amount and time
limitations can be waived upon affirmative vote of the City Commission; and
WHEREAS, the temporary event for an Open Air Retail, Place of Assembly, and Recreational
Establishment at the above location for an extended period of time would be beneficial to the City of
Miami's residents and furthers the redevelopment goals for the neighborhood by eliminating blight,
promoting a more walkable neighborhood, and generating economic activity;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b) (4) and (5), of the City Code, the temporary events

amount and time limitations (no more than two [2] events per property per year), for an Open Air
Retail, Place of Assembly, and Recreational Establishment to be held May 1, 2011 through April 30,
2014, at Grand Central Park, located at 721 Northwest 1 Avenue, Miami, Florida, are hereby waived
for said period and said permit.
Section 3.This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
