HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00287 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE DE -OBLIGATION OF STATE HOUSING INITIATIVE PROGRAM FUNDS, IN THE TOTAL AMOUNT OF $184,761, FROM THE FLORIDA HOMEBUYER OPPORTUNITY PROGRAM; ALLOCATING SAID FUNDS TO THE STRATEGIES LISTED UNDER THE APPROVED LOCAL HOUSING ASSISTANCE PLAN FOR FISCAL YEAR 2010-2013, AS SPECIFIED IN EXHIBIT "A", ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE(S). WHEREAS, on February 17, 2009, the President of the United States signed into law The American Recovery and Reinvestment Act of 2009 which established an $8,000 Federal First -Time Homebuyer Tax Credit for eligible first-time homebuyers purchasing primary residences before December 31, 2009; and WHEREAS, on May 27, 2009, the Governor for the State of Florida signed the law implementing the 2009-2010 Appropriations Act, which established the Florida Homebuyer Opportunity Program ("FHOP"); and WHEREAS, pursuant to Resolution No. 09-0366, adopted July 23, 2009, the Miami City Commission approved the acceptance of FHOP funds, in the amount not to exceed $188,561; and WHEREAS, the FHOP has expired with a balance of $184,761 remaining in the program account; and WHEREAS, on November 5, 2010, the Florida Housing Finance Corporation advised the City of Miami ("City") that any remaining funds under the FHOP can be used for eligible State Housing nitiative-Program-("SHIP")-strategies-approved-underthe-tocal-Housing Assistance -Plan -("CHAP"); and WHEREAS, the City Administration recommends the de -obligation of SHIP funds, in the total amount of $184,761, from the FHOP and the allocation of said funds to the strategies listed under the approved LHAP for Fiscal Year 2010-2013, as specified in Exhibit "A", attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The de -obligation of SHIP funds, in the total amount of $184,761, from the FHOP and City of Miami Page 1 of 2 File Id: 11-00287 (Version: 1) Printed On: 4/14/2011 File Number. 11-00287 the allocation of said funds to the strategies listed under the approved LHAP for Fiscal Year 2010- 2013, as specified in Exhibit "A", attached and incorporated, is authorized. Section 3. The City Manager is authorized {1} to execute any necessary documents, in a form acceptable to the City Attorney, for said purpose(s). Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS:C/ JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
