HomeMy WebLinkAboutR-11-0169City of Miami Legislation Resolution: R-11-0169 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00399 Final Action Date: 4/28/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), URGING GOVERNOR RICK SCOTTAND THE MEMBERS OF THE FLORIDA LEGISLATURE TO OPPOSE THE LANGUAGE FOUND IN 2011 SESSION HOUSE BILL 1363, RELATING TO THE DEPARTMENT OF TRANSPORTATION, CREATING A STATUTE THAT LIMITS THE ABILITY OF MUNICIPALITIES TO ESTABLISH FEES CHARGED IN CONNECTION WITH SIGN PERMITS; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS DESIGNATED HEREIN. WHEREAS, because of the visual blight and deleterious effects to its neighborhoods resulting from billboards, the City of Miami ("City") has a substantial and significant governmental interest in reducing the number of billboards within the City, especially within its neighborhoods; and WHEREAS, the City also has a substantial and significant governmental interest in preventing the proliferation of illegally constructed billboards throughout the City; and WHEREAS, the City also has a substantial and significant governmental interest in promoting public safety and welfare by providing reasonable protection to the visual environment and by ensuring that billboards do not interfere with traffic safety or otherwise endanger public safety; and WHEREAS, the City also recognizes that the law protects maintenance of private investment in signage, including billboards, as a medium of commercial and noncommercial communication; and WHEREAS, under its Home Rule and Section 70.20, Florida Statutes, the City has adopted regulations that directly advance the public goals described above; and WHEREAS, under such regulations the City and sign owners are authorized to enter into relocation and reconstruction agreements that allow the City to accomplish the public goals expressed above without the expenditure of public funds; and WHEREAS, House Bill 1363 contains a provision creating Section 479.075, Florida Statutes, that would limit fees municipalities can charge in connection with sign permits; and WHEREAS, such limitation will impede the City's ability establish a payment schedule that advance its public goals with respect to the regulation of signs and would result in insufficient funding to administer the City's sign programs; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by City of Miami Page 1 of 2 File Id: 11-00399 (Version: 1) Printed On: 10/5/2017 File Number: 11-00399 Enactment Number: R-11-0169 reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission urges Governor Rick Scott and the members of the Florida Legislature to oppose the amendment to House Bill 1363 relating to the creation of Section 479.075, Florida Statutes, entitled sign permit fee limitations. Section 3. The City Clerk is directed to transmit a copy of this Resolution to Governor Rick Scott members of the Florida Legislature, the Florida League of Cities, the Miami -Dade League of Cities and the Miami -Dade Delegation. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
