HomeMy WebLinkAboutCRA-R-16-0042City of Miami Legislation CRA Resolution: CRA-R-16-0042 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-01281 Final Action Date: 9/13/2016 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY ("CRA") ADOPTING THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, AS MAY BE AMENDED FROM TIME TO TIME, AS THE PROCESS IN WHICH ANY AND ALL SERVICES AND GOODS SHALL BE PROCURED BY THE CRA. WHEREAS, the Omni Redevelopment District Community Redevelopment Agency ("CRA") was created pursuant to Chapter 163 of the Florida Statutes; and WHEREAS, from time to time, the CRA must procure services and/or goods in order to carry out the goals of the Redevelopment Plan; and WHEREAS, no formal process currently exists concerning the procurement of said services and/or goods; and WHEREAS, various government agencies have very specific laws in place that govern procurement processes; and WHEREAS, the intent of these laws is to provide fair competition, reduce opportunity for favoritism, and create an ethical process; and WHEREAS, while the CRA is not statutorily required to follow a specific procurement process, a formal process should be implemented in order to continue to provide for fair competition, reduce any opportunity for favoritism, and continue to create an ethical process; and WHEREAS, on or about February 3, 2016, the Miami -Dade County Grand Jury ("Grand Jury") issued a final report after analyzing many different community redevelopment agencies throughout Miami -Dade County; and WHEREAS, one of the findings of the Grand Jury was that various community redevelopment agencies throughout Miami -Dade County do not utilize a formal procurement process which has led to mismanagement, waste, collusion, and corruption; and WHEREAS, the Grand Jury recommended that Chapter 163 of the Florida Statutes be amended to require formal procurement processes; and WHEREAS, notwithstanding that the state statute has not been amended, the Board of Commissioners of the CRA believes it is prudent to voluntarily follow the formal procurement process of the City of Miami as codified in Chapter 18, Articles III and V of the Code of the City of Miami, as amended ("City Code"); NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE OMNI City of Miami Page 1 of 2 File Id: 16-01281 (Version: 11 Printed On: 2/9/2022 File Number: 16-01281 Enactment Number: CRA-R-16-0042 REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The CRA shall implement the procurement process of the City of Miami as codified in Chapter 18, Articles III and V of the City Code as the formal procurement process for the CRA. Section 3. Any reference to City of Miami or City in Chapter 18, Articles III and V of the City Code shall be substituted with the CRA. Section 4. Any reference to City Manager or Chief Procurement Officer in Chapter 18, Articles III and V of the City Code shall be substituted with the Executive Director of the CRA. Section 5. Any reference to City Commission in Chapter 18, Articles III and V of the City Code shall be substituted with the Board of Commissioners of the CRA. Section 6.
