A RESOLUTION, WITH ATTACHMENT(S), OF THE BOARD OF COMMISSIONERS
OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT
AGENCY AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE A
PERPETUAL AERIAL EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM,
WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("DEPARTMENT") TO
ACCOMMODATE CONSTRUCTION AND MAINTENANCE OF A BRIDGE TO
IMPROVE STATE ROAD 836/1-395, SECTION NO. 2516881; FURTHER
AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE ALL DOCUMENTS
NECESSARY FOR SAID PURPOSE AND TO TAKE ALL ACTIONS NECESSARY TO
ACCOMPLISH THE TRANSFER OF SAID PERPETUAL EASEMENT.
WHEREAS, the Southeast Overtown/Park West Community Redevelopment Agency ("CRA") is a
community redevelopment agency created pursuant to Chapter 163, Florida Statutes, and is
responsible for carrying out community redevelopment activities and projects within its Redevelopment
Area in accordance with the 2009 Southeast Overtown/Park West Redevelopment Plan ("Plan"); and
WHEREAS, Section IV(2), at page 100, of the Plan lists the coordination of infrastructure
improvements with the public agencies, including the State of Florida's Department of Transportation
("FDOT"); and
WHEREAS, the Plan, at page 123, acknowledges FDOT's plans to improve the State Road 836/1-395;
and
WHEREAS, FDOT has requested a perpetual aerial easement from the CRA in connection to FDOT's
proposed improvements to State Road 83611-395, Section No. 2516881, in Miami -Dade County,
Florida; and
WHEREAS, the Board of Commissioners wishes to authorize the execution of a perpetual aerial
easement, in substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated herein as if fully set forth in this Section.
Section 2. The Board of Commissioners hereby authorizes the execution of a perpetual aerial

easement, in substantially the attached form, with the State of Florida's Department of Transportation
to accommodate the construction and maintenance of a bridge to improve State Road 83611-395,
Section No. 2516881.
Section 3. The Executive Director is authorized to execute all documents necessary for said purpose
and to take all actions necessary to accomplish the transfer of said perpetual easement.
Section 4. This Resolution shall become effective immediately upon its adoption.
