HomeMy WebLinkAboutR-24-0301City of Miami Resolution R-24-0301 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16354 Final Action Date: 7/25/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), BY A FOUR FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") AND WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING GRANT FUNDS FROM THE DISTRICT 1 COMMISSIONER'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE IN A TOTAL AMOUNT NOT TO EXCEED ONE HUNDRED AND TWENTY THOUSAND DOLLARS ($120,000.00) TO ALLAPATTAH COMMUNITY ACTION, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("ALLAPATTAH COMMUNITY "), IN SUPPORT OF THE HOMEBOUND AND CONGREGATE MEALS PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Miguel Angel Gabela, Commissioner Manolo Reyes WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, Allapattah Community Action, Inc., a Florida not for profit corporation ("Allapattah Community"), is seeking funding for their Homebound and Congregate Meals Program which provides congregate and homebound meals to elderly residents within City Commission District 1 ("Program"); and WHEREAS, in addition to this Program, Allapattah Community provides recreation, transportation, immigration assistance, education, and nutrition services to low-income residents in the Allapattah area; and WHEREAS, the City's District 1 Commissioner ("Commissioner") wishes to provide additional grant funds from the Commissioner's share of the City's API in an amount not to exceed One Hundred and Twenty Thousand Dollars and Zero Cents ($120,000.00) ("Funds") for the Program; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made a written finding, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of the Funds for the Program; and City of Miami Page 1 of 2 File ID: 16354 (Revision:) Printed On: 8/15/2024 File ID: 16354 Enactment Number: R-24-0301 WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for said allocation of Funds for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of the Funds for the Program and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate the Funds from the Commissioner's share of the City's API to Allapattah Community Action, Inc. for the Program. Section 4. The City Manager is further authorized1 to negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for said purpose. Section 5.
