HomeMy WebLinkAboutCRA-R-13-0036 LegislationCity of Miami Legislation CRA Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00686 Final Action Date: A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY ("CRA"), WITH ATTACHMENT(S), AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE A LEASE, IN SUBSTANTIALLY THE ATTACHED FORM, WITH 1401 GROUP, LLC., FOR THE USE OF APPROXIMATELY 5,400 SQUARE FEET FOR A RESTAURANT FACILITY WITH A TERM EXPIRING SEPTEMBER 30, 2030, AND OTHER TERMS AS SET FORTH IN THE LEASE. WHEREAS, the Omni Redevelopment District Community Redevelopment Agency ("CRA") is responsible for carrying out community redevelopment activities and projects within its Redevelopment Area; and WHEREAS, the CRA Redevelopment Plan at Section 4, Goal D/ Principals A-2, C-4 and C-5 lists as a goal: "encourage the restoration of historic buildings and [enhance the area's visual attractiveness to businesses and residents], by creating opportunities for new development through improvements to the public realm"; and WHEREAS, the CRA desires to enter into a lease with 1401 Group, LLC. ("Lessee") for approximately 5,400 square feet for restaurant facility with a term expiring September 30, 2030 ("Lease"); and WHEREAS, after the first 18 months following the effective date, Lessee shall pay to the CRA the greater of a minimum of $80,000 per year in rent, or 7% of gross sales to increase to 8.5% in month 54 of the Lease; and WHEREAS, Lessee shall invest approximately $1,800,000 in the build out of the restaurant, substantially completing construction in the manner and scope presented in its submission to the CRA; and WHEREAS, the CRA shall install the grease trap and hood system for the restaurant in a not to exceed amount of $60,000; and WHEREAS, the parties shall review the Lease every five years to ensure that the Lessee is paying the CRA fair market rent for the restaurant. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. The Executive Director is authorized to enter into a Lease with 1401 Group, LLC., in substantially the attached form, for the use of approximately 5,400 square feet for a restaurant facility until September 30, 2030, and other terms as set forth in the Lease.
