Legislation; Attachment BACKGROUND: It is recommended that the Board of Commissioners of the Southeast Overtown/Park West Community Redevelopment Agency ("CRA") adopt the attached Resolution authorizing the execution of a license agreement, in substantially the attached form, with CBS Outdoor, Inc. for the purpose of installing and operating an advertising sign at 1490 NW 3rd Avenue, in Overtown. The CRA owns the property at 1490 NW 3rd Avenue, in Overtown ("licensed premises"), and is responsible for maintenance and/or improvement of same. CBS Outdoor, Inc. seeks to install and operate an advertising sign on the licensed premises. The CBS Outdoor, Inc. and the CRA have negotiated the attached license agreement, which calls for the CRA's receipt of an annual license fee in consideration for CBS Outdoor, Inc.'s installation and operation of an advertising sign on the licensed premises. Specifically, the annual license fee would be the greater of: $75,000 or twenty-five percent (25%) for years one through ten (1-10) and thirty percent (30%) for the remaining term of the gross revenues realized by CBS Outdoor, Inc. from the advertising sign. Additionally, in the third year of the agreement, the CRA would receive an escalation rate of an amount equal to the Seventy -Five Percent (75%) of the percentage change in the Consumer Price Index. CBS Outdoor, Inc. would be responsible for all costs associated with the installation, operation, and maintenance of the advertising sign. JUSTIFICATION: The funds received by the CRA from CBS Outdoor, Inc. in connection to the attached license agreement enable the CRA to offset its obligations to maintain and/or improve the licensed premises, or alternatively, enable the CRA to undertake other redevelopment activities in accordance with the CRA's Plan.
