HomeMy WebLinkAboutCRA-R-10-0097 11-18-2010 LegislationCity of Miami Legislation CRA Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01320 Final Action Date: A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY (THE "CRA"), WITH ATTACHMENT(S), AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), FOR THE SALE OF A PORTION OF THE MIAMI SKILL CENTER PROPERTY, LOCATED AT 29 N.W. 13TH STREET, MIAMI, FLORIDA ("MIAMI SKILL CENTER"), WHICH THE CRA IS ACQUIRING FROM THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA ("SCHOOL BOARD"), TO FDOT, AS A CONDITION OF THE SCHOOL BOARD APPROVING THE SALE OF THE MIAMI SKILL CENTER TO THE CRA, AND THE LEASEBACK OF THE PROPERTY SOLD TO FDOT FOR $1.00 TRIPLE NET UNTIL FDOT IS PREPARED TO START CONSTRUCTION OF THE EXPANSION OF 1-395. WHEREAS, the Omni Redevelopment District Community Redevelopment Agency ("CRA") is responsible for carrying out community redevelopment activities and projects within its Redevelopment Area in accordance with its approved Redevelopment Plan; and WHEREAS, Section 4.4, D., at page 42, of the 2009 Omni Area Redevelopment Plan lists "[the elimination of] conditions which contribute to blight," as a stated redevelopment objective; and WHEREAS, on April 20, 2010, The School Board of Miami -Dade County (the "School Board") issued a request for bids for the purchase of a three -acre site located at 29 N.W. 13th Street, Miami, Florida ("Miami Skill Center" or "Property"); and WHEREAS, the Board of Commissioners, by Resolution No. CRA-R-10-0045, passed and adopted on May 13, 2010, ratified the CRA's bid submission for the Miami Skill Center, and further authorized the purchase of said property, in an amount not to exceed $3,100,101; and WHEREAS, the bid submitted by the CRA was the highest and best bid, however, FDOT objected to the award of the bid to the CRA because FDOT required the southern portion of the Property for the planned expansion of 1-395; and WHEREAS, the staff of the School Board would not recommend that the School Board approve the sale of the Property to the CRA unless the CRA resolved issues with FDOT regarding the Property; and WHEREAS, FDOT has planned an expansion of the 1-395 expressway which is located along the southern border of the Property; and WHEREAS, it was the intent of FDOT to acquire the entire Property through condemnation to enable their efforts for the expansion of 1-395; and City of Miami Page 1 of 2 File Id: 10-01320 (Version: 1) Printed On: 11/10/2010 File Number: 10-01320 WHEREAS, to allow the CRA to continue with its planned redevelopment of the Miami Skill Center, FDOT has agreed to purchase from the CRA, only that southern portion of the Property needed for the 1-395 expansion; and WHEREAS, the CRA will sell to FDOT that southern portion of the Property needed for the 1-395 expansion for a purchase price of $26.00 per square foot which is slightly more than the price to be paid by the CRA to the School Board for the purchase of the Miami Skill Center; and WHEREAS, until such time FDOT begins its planned expansion of 1-395, FDOT further agreed to lease that southern portion of the Property back to the CRA for a term of at least 18 months, with a rent of $1 for the term of the triple net lease; and WHEREAS, the CRA has agreed to grant FDOT a right of first offer if the CRA ever elects to sell the balance of the Property as a condition of the transaction; and WHEREAS, the Board of Commissioners wishes to authorize the execution of an agreement, in substantially the attached form, for the sale and lease of a portion of the Miami Skill Center property; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The Executive Director is authorized to execute an agreement, in substantially the attached form, with the Florida Department of Transportation, for the sale and lease of a portion of the Miami Skill Center property, located at 29 Northwest Thirteenth Street, Miami, Florida.
