Bockweg Executive Director Date: November 8, 2010 File: 10-01320 Subject: Resolution Authorizing Sale & Leaseback Agreements between the CRA and FDOT for the Southern Portion of Miami Skill Center Property. References: Enclosures: Legislation BACKGROUND: It is recommended that the Board of Commissioners of the Omni Redevelopment District Community Redevelopment Agency ("CRA") approve and adopt the attached Resolution authorizing the execution of an agreement with the Florida Department of Transportation ("FDOT"), for the sale and leaseback to the CRA of the southern portion of the Miami Skill Center Property. The Board of Commissioners, by Resolution No. CRA-R-10-0045, passed and adopted on May 13, 2010, authorized the purchase of the Miami Skill Center from Miami -Dade County Public Schools ("School Board, for an amount not to exceed $3,100,101. The bid submitted was the highest and best bid, however, FDOT objected to the award of the bid to the CRA because FDOT required the southern portion of the Property for the planned expansion of the 1-395 expressway. The School Board's staff would not recommend an approval of the sale of the Property to the CRA unless the CRA resolved issues with FDOT. To allow the CRA to continue with its planned redevelopment of the Property, FDOT has agreed to purchase the southern portion of the Property for a price of $26.00 per square foot (slightly more than the price to be paid by the CRA to the School Board). FDOT will then lease that southern portion back to the CRA for a period of at least 18 months, with a rent of one dollar ($1.00) for the term of the triple net lease. JUSTIFICATION: Section 4.4, D., at page 42, of the 2009 Omni Area Redevelopment Plan lists "[the elimination of] conditions which contribute to blight," as a stated redevelopment objective. This resolution carries out this objective.
