A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE SOUTHEAST
OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY
AUTHORIZING THE GRANT OF A REVOCABLE LICENSE TO EXILE II
ENTERTAINMENT, INC. ("CLUB 90 DEGREE"), FOR THE LIMITED PURPOSE OF
THE PLACEMENT OF A STAIRCASE/FIRE ESCAPE UPON THE GRAND
PROMENADE; AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE ALL
DOCUMENTS NECESSARY FOR SAID PURPOSE, IN A FORM ACCEPTABLE TO
SPECIAL COUNSEL.
WHEREAS, the Southeast Overtown/Park West Community Redevelopment Agency ("CRA")
is responsible for carrying out community redevelopment activities and projects within its
Redevelopment Area in accordance with its approved Redevelopment Plan; and
WHEREAS, Section 2, Goal 5/Principle 6, at pages 11 and 15, of the 2009 Southeast
Overtown/Park West Redevelopment Plan lists "the support . . . of existing business and local
entrepreneurs," as a stated redevelopment goal; and
WHEREAS, Exile II Entertainment, Inc. operates a club ("Club 90 Degree"), located at 90 N.E.
11th Street, Miami, Florida, which is situated along an alleyway ("Grand Promenade") owned by the
Southeast Overtown/Park West Community Redevelopment Agency ("CRA"); and
WHEREAS, the maximum occupancy level of Club 90 Degree has been reduced by City of
Miami fire officials due to the limited number of available exits in the event of an emergency; and
WHEREAS, Club 90 Degree has proposed to place a staircase in the rear portion of their
building to provide an additional exit as recommended by City of Miami fire officials, in an effort to
raise the maximum occupancy level; and
WHEREAS, the placement of said staircase will be entirely upon the land owned by the CRA;
and
WHEREAS, Club 90 Degree requests permission to place said staircase upon the CRA's
property allowing for an increase in the club's maximum occupancy level; and
WHEREAS, the Board of Commissioners wishes to authorize the grant of a revocable license
to Exile II Entertainment, Inc., for the limited purpose of the placement of a staircase/fire escape upon
the Grand Promenade;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated herein as if fully set forth in this Section.
Section 2. The grant of a revocable license to Exile II Entertainment, Inc., for the limited
purposes of the placement of a staircase/fire escape upon the Grand Promenade, is authorized.
Section 3. The Executive Director is authorized to execute all documents necessary for said
purpose, in a form acceptable to Special Counsel.
Section 4. This resolution shall become effective immediately upon its adoption.
