A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE OMNI
REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY
URGING THE MIAMI CITY COMMISSION TO ENACT AN ORDINANCE AMENDING
CHAPTER 4/ARTICLE 1 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "ALCOHOLIC BEVERAGES/IN GENERAL," MORE
PARTICULARLY BY AMENDING SECTION 4-2 TO CREATE NEW DEFINITIONS
AND AMENDING SECTION 4-3 TO LIMIT THE RETAIL SALE OF ALCOHOLIC
BEVERAGES FROM CONVENIENCE STORES LOCATED IN THE OMNI
REDEVELOPMENT AREA; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE;
DIRECTING THE EXECUTIVE DIRECTOR TO TRANSMIT A COPY OF THIS
RESOLUTION TO THE CITY MANAGER FOR REVIEW AND CONSIDERATION.
WHEREAS, the Omni Redevelopment District Community Redevelopment Agency ("CRA") is
responsible for carrying out redevelopment activities and projects within the Redevelopment Area in
accordance with its approved Redevelopment Plan; and
WHEREAS, the CRA wishes to promote the health, safety, and welfare of residents within the
Redevelopment Area; and
WHEREAS, convenience stores may currently sell beer and wine in sealed containers for
consumption off the premises during such hours as their stores legally remain open for the sale of
other goods within the Redevelopment Area; and
WHEREAS, many of the convenience stores located in the Omni Redevelopment Area are
open twenty-four (24) hours a day and seven (7) days a week, meaning that alcoholic beverages are
offered for sale at all hours of the day and night; and
WHEREAS, the curtailment of the hours of sale of alcoholic beverages from convenience
stores in the Omni Redevelopment Area will promote the health, safety, and general welfare of these
areas and their inhabitants, visitors, property owners, and workers; to establish, maintain, and
preserve property values and preserve and foster the development of attractive neighborhood and
business environments and will reduce crime rates and the opportunities for the commission of crime;
and to provide improvements in neighborhoods so they are defensible against crime;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated herein as if fully set forth in this Section.

Section 2. The Board of Commissioners of the Omni Redevelopment District Community
Redevelopment Agency urges the Miami City Commission to enact an ordinance amending Chapter
4/Article 1 of the Code of the City Of Miami, Florida, as amended, entitled "Alcoholic Beverages/In
General," more particularly by amending Section 4-2 to create new definitions and amending Section 4
-3 to limit the retail sale of alcoholic beverages from convenience stores located in the Omni
Redevelopment Area; containing a repealer provision, a severability clause, and providing for an
effective date.
Section 3. The Executive Director is directed to transmit a copy of this resolution to the City
Manager for review and consideration.
Section 4. This Resolution shall become effective immediately upon its adoption.
