A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE SOUTHEAST
OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY, WITH
ATTACHMENT(S), AUTHORIZING EXECUTION OF AN AMENDMENT TO THE 1983
INTERLOCAL AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH
THE CITY OF MIAMI AND MIAMI-DADE COUNTY.
WHEREAS, the Board of County Commissioners of Miami -Dade County, by Resolution No.
R-01677-82 and Ordinance No. 82-115, approved the Southeast Overtown/Park West Community
Redevelopment Plan ("1982 Plan") and tax increment financing for the Southeast Overtown/Park
West Redevelopment Area ("Original Redevelopment Area"); and
WHEREAS, on March 31, 1983, the City of Miami and Miami -Dade County entered into an
Interlocal Agreement, which among other things, delineated those areas of responsibility for the
redevelopment of the Original Redevelopment Area ("1983 Interlocal Agreement"); and
WHEREAS, on December 31, 2007, the City of Miami, Miami -Dade County, the SEOPW CRA,
and the Omni Redevelopment District Community Redevelopment Agency entered into an Interlocal
Agreement, which provided, among other things, for the expansion of the boundaries of the
Redevelopment Area and the extension of its life ("2007 Agreement"); and
WHEREAS, the Board of Commissioners, by Resolution No. CRA-R-09-0014, passed and
adopted on March 12, 2009, accepted the Finding of Necessity Report ("FON") prepared by
Olmedillax5, Inc. for the area proposed to be included in the Redevelopment Area ("Study Area"), and
directed the Executive Director to transmit a copy of the FON to the City Manager for review and
consideration; and
WHEREAS, the Miami City Commission, by Resolution No. R-09-0107, passed and adopted
on March 12, 2009, accepted the FON, and directed the City Manager to transmit a copy of the FON
to Miami -Dade County for review and consideration; and
WHEREAS, in accordance with Section 163.360(4), the SEOPW CRA submitted the 2009
Southeast Overtown/Park West Redevelopment Plan ("2009 Plan"), prepared by Dover, Kohl &
Partners and updated by the City of Miami Planning Department, to the City of Miami's Planning
Advisory Board (the "PAB"); and
WHEREAS, the PAB, by Resolution No. PAB-09-018, passed and adopted on May 27, 2009,
found that the 2009 Plan was in conformity with the City's Neighborhood Comprehensive Plan, and
recommended approval by the Miami City Commission; and
WHEREAS, the Board of Commissioners, by Resolution No. CRA-R-09-0035, passed and
adopted on May 28, 2009, accepted the 2009 Plan, and directed the Executive Director to transmit a

copy of the 2009 Plan to the Miami City Commission and Miami -Dade County for legislative action;
and
WHEREAS, the Miami City Commission, by Resolution No. R-09-0270, passed and adopted
on May 28, 2009, accepted the 2009 Plan; and
WHEREAS, the Board of County Commissioners, by Resolution Nos. R-1038-09 and
R-1039-09, both passed and adopted on July 23, 2009, declared the Study Area to be slum and
blight and adopted the 2009 Plan, subject to the City and the CRA's execution of an Amendment to
the 1983 Interlocal Agreement ("Amendment"); and
WHEREAS, the Board of Commissioners wishes to authorize the Executive Director to
execute the Amendment, in substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY
OF MIAMI, FLORIDA;
Section 1. The recitals and findings contained in the Preamble to this resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. Execution of an Amendment to the 1983 Interlocal Agreement, in substantially
the attached form, with the City of Miami and Miami -Dade County is authorized.
Section 3. This Resolution shall become effective immediately upon its adoption.
