HomeMy WebLinkAboutCRA-R-08-0067City of Miami Legislation CRA Resolution: CRA-R-08-0067 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-01465 Final Action Date: 12/15/2008 A JOINT RESOLUTION OF THE BOARDS OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST AND OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCIES ("CRAS") AUTHORIZING REIMBURSEMENT OF FY 2008 TRUST REVENUES COLLECTED BY THE CRAS, IN AN AMOUNT NOT TO EXCEED $662,144, TO THE CHILDREN'S TRUST, MIAMI-DADE COUNTY, AN INDEPENDENT SPECIAL TAXING DISTRICT; AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE ALL DOCUMENTS NECESSARY FOR SAID PURPOSE; ALLOCATING FUNDS AS FOLLOWS: $215,813 FROM SEOPW TAX INCREMENT FUND, "OTHER CURRENT CHARGES AND OBLIGATIONS," ACCOUNT CODE NO. 10050.920101.549000.0000.00000; AND $446,331 FROM OMNI TAX INCREMENT FUND, "OTHER CURRENT CHARGES AND OBLIGATIONS," ACCOUNT CODE NO. 10040.920101.549000.0000.00000. WHEREAS, the Southeast Overtown/Park West and Omni Redevelopment District Community Redevelopment Agencies ("CRAs") are responsible for carrying out community redevelopment activities and projects within their Redevelopment Areas in accordance with their respective Redevelopment Plans; and WHEREAS, The Children's Trust, Miami -Dade County, an independent special taxing district ("Trust") was established for the purpose of funding improvements to children's health, development and safety, and to promote parental and community responsibility for children who reside in Miami -Dade County; and WHEREAS, the Trust is funded by the levy of a half -mil tax on nonexempt real property approved by the voters of Miami -Dade County on September 10, 2002; and WHEREAS, Florida's Community Redevelopment Act requires taxing authorities to pay increment income generated within a community redevelopment area to the community redevelopment agency; and WHEREAS, on October 7, 2003, the Board of County Commissioners of Miami -Dade County ("Board") adopted Ordinance No. 03-210, which requires, as a condition precedent to the Board's consideration of any matter concerning a community redevelopment agency, that municipalities, in their sole discretion, exempt the Trust from the provisions of Florida's Community Redevelopment Act; and WHEREAS, the Boards of Commissioners of the CRA, by Resolution No. CRA-R-06-0008, passed and adopted on March 9, 2006, authorized the Executive Director to execute an agreement with the Trust to allow the Trust to benefit from its levy of a half -mil tax on real property located within the CRAs' Redevelopment Areas; and City of Miami Page 1 of 2 File Id: 08-01465 (Version: 1) Printed On: 12/27/2022 File Number: 08-01465 Enactment Number: CRA-R-08-0067 WHEREAS, on August 6, 2007, the Trust, the CRAs, the City of Miami, and Miami -Dade County entered the Interlocal Agreement authorized by Resolution No. CRA-R-06-0008 ("Interlocal Agreement"); and WHEREAS, Section 2 of the Interlocal Agreement provides that the CRAs will "remit to the Trust ... all of the Trust Revenues that are not needed for debt service on ... existing debts of the CRAs;" and WHEREAS, the Boards of Commissioners wish to authorize reimbursement to the Trust of FY 2008 Trust Revenues collected by the CRAs and not needed for debt service, in an amount not to exceed $662,144, as provided in the Interlocal Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE BOARDS OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST AND OMNI REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCIES OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The reimbursement of FY 2008 Trust Revenues collected from the Redevelopment Areas, in an amount not to exceed $662,144, to The Children's Trust, Miami -Dade County, an independent special taxing district, is authorized. Section 3. The Executive Director is authorized to execute all documents necessary for said purpose. Section 4. Funds are to be allocated as follows: $215,813 from SEOPW Tax Increment Fund, "Other Current Charges and Obligations," Account Code No. 10050.920101.549000.0000.00000; and $446,331 from Omni Tax Increment Fund, "Other Current Charges and Obligations," Account Code No. 10040.920101.549000.0000.00000.
