BACKGROUND:
The City of Miami, the Southeast Overtown/Park West Community Redevelopment Agency ("CRA") and Miami -
Dade County entered into a settlement agreement in the case of Miami -Dade County v. the City of Miami and
Southeast Overtown/Parkwesf Community Redevelopment Agency, Case No. 01-13810 CA (08). The litigation
involved Miami -Dade County's alleged reversionary interest in blocks 36, 45, and 56 in Overtown. Subject to
certain conditions and extensions, the settlement provided for transfer of title to the blocks if the City and/or CRA
had not "commenced construction of development" on all of the blocks by August 1, 2007. Blocks 45 and 46 are
part of the Sawyers Walk development and block 36 is part of an upcoming Request For Proposals. The
attached resolution seeks authorization for the Executive Director to execute an amendment to the Settlement
Agreement, in a form acceptable 10 CRA General Counsel, to extend the reverter date.
JUSTIFICATION:
The CRA and the City have engaged in extensive negotiations to provide for the development of 1,050 housing
units on blocks 45, 46, 55, and 56 in Overtown. A Major Use Special Permit has been issued by the City of
Miami for construction of this development. Miami -Dade County claims a right of reverter on two of these blocks
as well as on block 36. The City, the CRA, and Miami -Dade County have negotiated an extension to the
settlement agreement to allow this development to proceed and provide additional time for development of block
36.
