HomeMy WebLinkAboutCRA-R-06-0052 legislationCity of Miami Legislation CRA Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Fite Number: 06-02134 Final ,action Date: A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE A GUARANTEED MAXIMUM PRICE AMENDMENT TO THE CONSTRUCTION MANAGER -AT -RISK AGREEMENT WITH DESIGN -BUILD INTERAMERICAN, IN AN AMOUNT NOT TO EXCEED $752,903.99, FOR THE RENOVATION AND EXPANSION OF JACKSON SOUL FOOD RESTAURANT AT 950 NORTHWEST 3RD AVENUE, MIAMI, FLORIDA, CONTINGENT UPON APPROVAL OF GENERAL COUNSEL.; RATIFYING THE EXPENDITURE OF FUNDS IN THE AMOUNT OF $19,500 FOR DBI'S PRE -CONSTRUCTION SERVICES; AUTHORIZING EXPENDITURE OF $7,596.01 FOR REIMBURSABLE EXPENSES INCLUDING, BUT NOT LIMITED TO, PERMIT FEES, BONDS, INSURANCE, IMPACT FEES, AND CONTINGENCIES, FOR A TOTAL AMOUNT NOT TO EXCEED $780,000; FUNDS TO BE ALLOCATED FROM SEOPW TIF FUND, "CONSTRUCTION IN PROGRESS," ACCOUNT CODE NO. 10050.920101.670000.0000.00000. WHEREAS, the Southeast Overtown/Park West Community Redevelopment Agency ("CRA") is responsible for carrying out community redevelopment activities and projects in accordance with its Redevelopment Plan; and WHEREAS, as part of the redevelopment of the third avenue business corridor, the Board of Commissioners, by Resolution No. SEOPW/CRA R-03-100, passed and adopted on December 8, 2003, authorized execution of a restated grant agreement for the renovation and expansion of Jackson Soul Food Restaurant (the "Project"), at 950 Northwest 3rd Avenue, Miami, Florida; and WHEREAS, pursuant to Resolution No. SEOPW/CRA 02-38, passed and adopted on February 25, 2002, the CRA entered into a Construction Manager -at Risk Agreement with Design -Build InterAmerican, Inc. (''DBI"); and WHEREAS, the CRA, in conjunction with T.Y. Lin International/H.J. Ross, negotiated a Guaranteed Maximum Price ("GMP") for the Project with DBI, in an amount not to exceed $752,903.99; and WHEREAS, in addition to the GMP, there are other Project costs consisting of DBI's pre -construction services, in the amount of $19,500, and reimbursable expenses including, but not limited to, permit fees, bonds, insurance, impact fees, and contingencies in an amount not to exceed $7,596.01; and WHEREAS, the Board of Commissioners wishes to authorize the Executive Director to execute a GMP Amendment for the Project, ratify payment made for preconstruction services, and to authorize expenditure of budgeted funds for reimbursable expenses and contingencies; City of Miami Page 1 of 2 Printed On: 11/22/2006 File Number: 06-02134 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The Executive Director is authorized to execute a Guaranteed Maximum Price Amendment to the Construction Manager -at -Risk Contract with Design -Build InterAmerican, in an amount not to exceed $752,903.99, for renovation and expansion of Jackson Soul Food Restaurant contingent upon approval of General Counsel. Section 3. The Executive Director's expenditure of funds in the amount of $19,500 for DBI's pre -construction services is ratified. Section 4. The Executive Director's expenditure of funds in an amount not to exceed $7,596.01 for reimbursable expenses, including, but riot limited to, permit fees, bonds, insurance, impact fees, and contingencies is authorized. Section 5. Funds are to be allocated from SEOPW TIF Fund, "Construction in Progress," Account Code No. 10050.920101.670000.0000.00000. Section 6.
