Enclosures: Supporting Documentation; Legislation It is recommended that the Board of Commissioners for both the Southeast Overtown/Park West and Omni Redevelopment District Community Redevelopment Agencies (CRAs) approve and adopt the attached Joint Resolution recommending that the City Administration prepare legislation to amend Chapter 4, of the Code of the City of Miami, entitled "Alcoholic Beverages", by specifically amending Section 4-11 (and any other sections required) — Exceptions to Distance Requirements in order to modify the district boundaries for the Park West Entertainment District, the Overtown Blues and Jazz Entertainment District and the Omni Entertainment District; and, in order to expand the permissible uses within such establishments located in the Park West Entertainment District to allow for a limited number of adult entertainment establishments therein. JUSTIFICATION: As both the SEOPW and Omni CRA Areas continue to develop, it has become apparent that modifications to the three neighboring entertainment districts be implemented. Presently, the three districts (see attached map) are distant from one another which create barriers of travel time and distance for pedestrian visitors to access one district from the other. The redrawn boundaries of all three districts, approved by the Omni Steering Committee on October 20, 2004, resolve this issue and allow visitors to park under 1-395, in the parking lots built by the Miami Parking Authority, and spill out directly into an entertainment district of their choice. The issue of increasing the number of adult entertainment establishments within the 24-hour district is one of concern and balance. Presently, the rules allow for only one establishment which has existed for some time on the corner of NE 11" Street and Miami Court. The SEOPW CRA has received increasing interest from various higher level clubs in the adult entertainment business who wants to locate in the 24-hour district. In an effort to establish a competitive playing field and yet still curb an explosion of this type of venue, it is recommended that a maximum of three (3) clubs be allowed and that it be restricted to only 111h Street and that no more than one (1) club be located per block.
