A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING AND DIRECTING THE CITY MANAGER TO CONVEY IN "AS IS"
CONDITION, THE REAL PROPERTY LOCATED AT 142 NORTHWEST 11
STREET, MIAMI, FLORIDA, AS LEGALLY DESCRIBED IN "EXHIBIT A,"
ATTACHED AND INCORPORATED, TO THE SOUTHEAST OVERTOWN/PARK
WEST REDEVELOPMENT DISTRICT, COMMUNITY REDEVELOPMENT
AGENCY, WITHIN WHOSE REDEVELOPMENT AREA THE PROPERTY LIES;
FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT CLAIM
DEED AND ALL OTHER NECESSARY DOCUMENTS TO EFFECTUATE SAID
CONVEYANCE.
WHEREAS, on July 13, 2001, the Southeast Overtown/Park West ("SEOPW") Community
Redevelopment Agency ("CRA") requested certain property appearing on the Miami -Dade County
("County") list of lands available for taxes, to be conveyed from the County; and
WHEREAS, on September 13, 2001, the County Board of County Commission passed and
adopted Resolution No. 981-01, authorizing conveyance to the City of Miami ("City") a parcel located
at 142 Northwest 11 Street, Miami, Florida; and
WHEREAS, on July 8, 2005, the County conveyed the property located at 142 Northwest 11
Street, Miami, Florida, to the City, pursuant to a duly executed County Deed dated July 8, 2005, for the
City to further convey the site to the SEOPW CRA, for the purpose of supporting the CRA's
redevelopment efforts;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} and directed to convey in "AS IS" condition, the real
property located at 142 Northwest 11 Street, Miami, Florida, as legally described in "Exhibit A,"
attached and incorporated to the SEOPW CRA, within whose redevelopment area the property lies.
Section 3. The City Manager is authorized{1} to execute a Quit Claim Deed and al! other
necessary documents to effectuate said conveyance.
Section 4. The City of Miami does not warrant the sufficiency of its title or any interest it may have
in the Property, nor does it make any covenant whatsoever as to this Property which is being
conveyed to the CRA "AS IS" and "WHERE IS" and which the CRA accepts "AS IS" and "WHERE IS."
Section 5. This Resolution shall become effective immediately upon its adoption and signature of

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

Background Information:
On July 13, 2001, the Southeast Overtown/Park West CRA requested certain property appearing on
the Miami -Dade County list of lands available for taxes, to be conveyed from the County. On
September 13, 2001, Miami -Dade County Board of County Commission passed and adopted
Resolution No, R-981-01, authorizing conveyance to the City of Miami of a parcel located at 142
N.W. 11 Street. On July 8, 2005, the County conveyed the property located at 142 N.W. 11 Street,
Miami, Florida to the City, pursuant to a duly executed County Deed dated July 8, 2005, for the City
to further convey the site to the Southeast Overtown/Park West CRA, for the purpose of supporting
the CRA's redevelopment efforts.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the City Commission of the City of Miami, Florida on
November 17, 2005, at 9:00 a.m., in the City Commission Chambers at City Hall, 3500
Pan American Drive, Miami, Florida, for the purpose of authorizing and directing the
City Manager to convey in "AS IS" condition, the real property located at 142 NW 11
Street, Miami, Florida, to the Southeast Overtown/Park West Redevelopment District,
Community Redevelopment Agency within whose redevelopment area the property lies.
Further authorizing and directing the City Manager to execute a quit claim deed and all
other documents which are necessary to effectuate said conveyance.
All interested persons are invited to appear and may be heard concerning this item.

TITLE
RESOLUTION AUTHORIZING CANCELLATION OF OMIT hD YEARS' TAXES PURSUANT
TO SECTION 197.502 (7), FLORIDA STATUTES, FOR PROPERTIES TO BE PURCHASED
FROM THE LIST OF LANDS AVAILABLE FOR TAXES BY THE SOUTHEAST
OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY; AND AUTHORIZING
CONVEYANCE TO THE CITY OF MIAMI OF A PARCEL LOCATED AT 142 N.W. 11TH
STREET IN THE EVENT THE PROPERTY ESCHEATS TO THE COUNTY
BODY
WHEREAS, Southeast Overtown/Park West Community Redevelopment Agency (CRA) has
expressed an interest in buying seven (7) properties as designated by the City of Miami in the attached
letter dated July 13, 2001, and appearing on the list of lands available for taxes; and
WHEREAS, one of those properties was recently purchased off the list of lands by a private company;
and
WHEREAS, one of the remaining six (6) properties may escheat to the County from the list of lands in
October, 2001, by tax deed free and clear of any liens including tax liens, if not purchased by a buyer
prior to such time; and
WHEREAS, Section 197.502 (7), Florida Statutes, provides for the purchase of properties appearing on
the list of lands available for taxes by the County or other governmental unit for the opening bid and
authorizes the County Commission to cancel the omitted years taxes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MIAMI-DADE COUNTY, FLORIDA, that pursuant to Section 197.502(7), Florida Statutes, this
Board authorizes the purchase by Southeast Overrtown!Park West Community Redevelopment Agency
(CRA) of those properties appearing on the list of lands available for taxes as designated by the City of
Miami for the opening bid less all omitted years' taxes which are hereby canceled, all as shown on the
attached Summary Sheet; and in the event the property located at 142 N.W. 1 lth Street does escheat to
the County, authorizes the conveyance of said property to the City by County deed signed by the
Mayor.
