A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SOUTHEAST
OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY ("CRA"),
WITH ATTACHMENT(S), AUTHORIZING THE EXECUTIVE DIRECTOR TO
EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO GENERAL
COUNSEL, WITH BERCOW AND RADELL, P.A., IN AN AMOUNT NOT TO
EXCEED $70,500 PLUS UP TO $3,000 FOR REIMBURSABLE EXPENSES, TO: (1)
AMEND THE DEVELOPMENT IMPACT FEE ORDINANCE FOR THE CRA
REDEVELOPMENT AREA AT A COST NOT TO EXCEED $28,500; (2) UPDATE
THE SOUTHEAST OVERTOWN/PARK WEST DEVELOPMENT OF REGIONAL
IMPACT (DRI) DEVELOPMENT ORDERS FOR INCREMENTS 1 AND II AT A COST
NOT TO EXCEED $22,000; (3) REVIEW THE FEASIBILITY OF INCREASING
INCREMENT 111 ALLOCATIONS TO MEET MARKET DEMAND AND LAND USES
AT A COST NOT TO EXCEED $12,000; AND (4) DETERMINE THE NECESSITY
OF EXPANDING THE DRI BOUNDARIES FOR INCREMENT III TO
INCORPORATE THE EXPANDED CRA BOUNDARIES APPROVED BY CITY OF
MIAMI ORDINANCE NO. 12247, PASSED AND ADOPTED ON JULY 27, 2002, AT
A COST NOT TO EXCEED $8,000, ALL AS MORE SPECIFICALLY DETAILED IN "
EXHIBIT A" ATTACHED HERETO; FUNDS TO BE ALLOCATED FROM SEOPW
TIF FUND, "PROFESSIONAL SERVICES - OTHER," ACCOUNT CODE NO.
689001.550108.6.270.
WHEREAS, pursuant to Resolution Nos. R-88-110 and R-88-111, both passed and adopted on
February 11, 1988, the Miami City Commission approved a Master Development Order and an
Increment I Development Order for the Southeast Overtown/Park West Community Redevelopment
Area; and
WHEREAS, pursuant to Resolution R-01-1159, passed and adopted on October 25, 2001, the
Miami City Commission authorized extension of the Increment I and II build -out dates to March 21,
2005 and March 21, 2010 respectively, and extended the Master Development Order build -out date to
March 22, 2013; and
WHEREAS, the City of Miami Planning and Zoning Department has advised that the Southeast
Overtown/Park West Master Development Orders for Increments I and II need to be updated to meet
market demand, to recognize new land uses, and to account for previously allocated development
credits that have been freed up due to the expiration of permits and/or demolition of buildings; and
WHEREAS, pursuant to City of Miami Ordinance No. 12247, passed and adopted on July 27, 2002
the boundaries of the Southeast Overtown/Park West Community Redevelopment Area are to be
expanded to include portions of West and North Overtown and areas beneath 1-395 and 1-95,
necessitating the amendment of the Increment and Master Development Orders; and
WHEREAS, pursuant to motion no. SEOPW/CRA M-01-23, passed and adopted on February 26,

2001, as amended by Resolution SEOPW/CRA R-01-137, passed and adopted on December 11,
2001, Bercow and Radell, P.A. was retained to provide professional services to bring the CRA into
compliance with the terms of the Development Orders for the Miami Downtown Development of
Regional Impact and the Southeast Overtown/Park West Development of Regional Impact; and
WHEREAS, Bercow and Radell, P.A. was instrumental in reviving Increment I and extending the
expiration dates for Increments I and II of the SEOPW Development of Regional Impact ("DRI"); and
WHEREAS, Bercow & Radell, P.A. is presently providing similar services to the City of Miami
Department of Planning and Zoning; and
WHEREAS, the CRA wishes to engage Bercow and Radell, P.A. to assist with the necessary DRI
amendment process for the CRA Redevelopment Area;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF SOUTHEAST
OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated herein as if fully set forth in this Section.
Section 2. The Executive Director is authorized to execute an agreement, in a form acceptable to
General Counsel, with Bercow and Radell, P.A., in an amount not to exceed $70,500 plus up to $3,000
for reimbursable expenses, to: (1) Amend the Development Impact Fee Ordinance for the CRA
Redevelopment Area at a cost not to exceed $28,500; (2) Update the Southeast Overtown/Park West
Development of Regional Impact ("DRI") Development Orders for Increments I and II at a cost not to
exceed $22,000; (3) Review the feasibility of increasing Increment III allocations to meet market
demand and land uses at a cost not to exceed $12,000; and (4) Determine the necessity of expanding
the DRI boundaries for Increment III to incorporate the expanded CRA boundaries approved by City of
Miami Ordinance No. 12247, passed and adopted on July 27, 2002, at a cost not to exceed $8,000, all
as more specifically detailed in Exhibit "A" attached hereto.
Section 3. Funds are to be allocated from SEOPW TIF Fund, "Professional Services- Other,"
Account Code No. 689001.550108.6.270.
Section 4. This Resolution shall become effective immediately upon its adoption,
