HomeMy WebLinkAboutSR Legislation (Version 2) 04-14-11City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00107 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 53, ARTICLE II, DIVISION 2 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED (THE "CODE"), ENTITLED "STADIUM AND CONVENTION CENTERS/CITY STADIUMS/MARINE STADIUM", TO ADJUST FEES RELATED TO THE USE OF THE PARKING LOT AT MARINE STADIUM TO BE COMPARABLE WITH OTHER GOVERNMENT IMPOSED FEES FOR SIMILAR FACILITIES, MORE PARTICULARLY BY AMENDING SECTION 53-53 (B)(1)(C) OF THE CODE; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Section 53-53 of the Code of the City of Miami, Florida, as amended (the "Code"), provides for the "Rental rates and associated charges and conditions" of the Marine Stadium and the adjoining parking lot ("Marine Stadium Parking Lot"); and WHEREAS, Section 53-53 of the Code currently allows use of the Marine Stadium Parking Lot for a flat fee, payable in advance, of $2,000 per day or $15.00 per square foot or portion thereof, whichever is greater; and WHEREAS, the fees associated with the use of the Marine Stadium parking lot are meant to attract events of interest to the City of Miami ("City") and at the same time generate revenue to the City; and WHEREAS, it is in the best interest of the City to amend Section 53-53 of the Code to adjust the fees to be competitive in the area with other government imposed fees for similar facilities; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section-1- The recitals -and -findings -contained in -the Preamble -to this -Ordinance are -adopted--- -- -- by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 53/Article II/Division 2 of the Code, entitled "Stadiums and Convention Centers/City Stadiums/Marine Stadium" is amended in the following particulars: {1} "CHAPTER 53 STADIUMS AND CONVENTION CENTERS ARTICLE I1. Rental rates and associated charges and conditions. * * * (b) Admission tax and minimum charges. (1) Except as otherwise provided in this section, charges by the city for the use of the stadium shall be assessed as follows: * c. For the use of the parking lot only, for a commercial, video shoot or feature imagery, there shall be assessed a flat fee, payable in advance, of the greater of $2,000 $750.00 per day. For all other uses, the flat fee shall be assessed at $2,500 per day up to five (5) days or $15 per square foot or portion thereof. If set-up or teardown is required during use, there shall be a fee of $1,000 per day, which shall be limited to one (1) day prior and one (1) day after the event. Usage of the parking lot for longer than five (5) days shall be assessed at fair market value. Fair Market Value is defined as the amount that would be paid for a similar property used in substantially the same manner as the subject property, in a competitive and open market, under similar conditions in an arms -length transaction. This fee does not include any stadium costs. All event costs, including but not limited to electricity used, security deposit, electricians, cleanup, police department personnel required for traffic control and crowd control, etc., shall be paid by the user. Section 3. If any section, part of Section, paragraph, clause, phrase, or word of this Ordinance ---is-deciared-invaiid the -remaining -provisions -of -this -Ordinance -shall -not -be -affected: ----------- Section 4. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
