AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
53, ARTICLE II, DIVISION 2 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED (THE "CODE"), ENTITLED "STADIUM AND
CONVENTION CENTERS/CITY STADIUMS/MARINE STADIUM" TO ADJUST
FEES RELATED TO THE USE OF THE PARKING LOT AT MARINE STADIUM,
MORE PARTICULARLY BY AMENDING SECTION 53-53 (B)(1)(C) OF THE
CODE; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN
IMMEDIATE EFFECTIVE DATE.
WHEREAS, Section 53-53 of the Code of the City of Miami, Florida, as amended (the "Code"),
provides for the "Rental rates and associated charges and conditions" of the Marine Stadium and the
adjoining parking lot ("Marine Stadium Parking Lot"); and
WHEREAS, Section 53-53 of the Code currently allows use of the Marine Stadium Parking Lot
for a flat fee, payable in advance, of $2,000 per day or $15.00 per square foot, per day; whichever is
greater; and
WHEREAS, the fees associated with the use of the Marine Stadium parking lot are meant to
attract events of interest to the City and at the same time generate revenue to the City of Miami
("City"); and
WHEREAS, it is in the best interest of the City to amend Section 53-53 of the Code to adjust
the fees to be competitive in the area with other government imposed fees for similar facilities;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 53/Article II/Division 2 of the Code, entitled "Stadiums and Convention
Centers/City Stadium/Marine Stadium" is amended as follows: {1}

(b) Admission tax and minimum charges.
(1) Except as otherwise provided in this section, charges by the city for the use of the
stadium shall be assessed as follows:

c. For the use of the parking lot only, there shall be assessed a flat fee, payable in
advance, of the greater of $2,000 $2.500 per day or $15 per squat- —foot--or portion
thereof. This fee does not include any stadium costs. All event costs, including but not
limited to electricity used, security, electricians, cleanup, police department personnel
required for traffic control and crowd control, etc., shall be paid by the user.
Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading.{2}
