HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00313 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY ATTORNEY TO PURSUE ANY PRE -SUIT REMEDIES AND/OR SEEK DECLARATORY AND INJUNCTIVE RELIEF, AND ANY OTHER ACTIONS AT LAW OR IN EQUITY, AGAINST MIAMI-DADE COUNTY, AND ALL NECESSARY BODIES, TO CLARIFY THAT THE MIAMI-DADE COUNTY COMMISSION ON HUMAN RIGHTS DOES NOT HAVE THE AUTHORITY UNDER THE FLORIDA CONSTITUTION, STATE LAW OR THE MIAMI-DADE COUNTY CHARTER TO IMPOSE REMEDIES UPON MUNICIPALITIES IN MIAMI-DADE COUNTY, SUCH AS THE CITY OF MIAMI, FOR ALLEGED VIOLATION OF THE MIAMI-DADE COUNTY DISCRIMINATION ORDINANCE, SECTION 11A ET SEQ. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney is authorized to pursue any pre -suit remedies and/or seek declaratory and injunctive relief, and any other actions at law or in equity, against Miami -Dade County, and all necessary bodies, to clarify that the Miami -Dade County Commission on Human Rights does not have the authority under the Florida Constitution, state law or the Miami -Dade County Charter to impose remedies upon municipalities in Miami -Dade County, such as the City of Miami, for alleged violation of the Miami -Dade County Discrimination Ordinance, Section 11A et seq. Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1 } APPROVED AS TO FORM AND CORRECTNESS: JULIE ()Jed CITY ATTORNEY Footnotes: {1) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
