Ms. Ileana Hernandez -Acosta offered the following resolution and moved its adoption
Resolution:
AFTER CONSIDERING THE FACTORS SET FORTH IN ZONING ORDINANCE NO.
11000, THE ZONING BOARD APPROVED THE SPECIAL EXCEPTION AS LISTED IN
ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY
OF MIAMI, ARTICLE 4, SECTION 401, FOR PROPERTY ZONED "0" OFFICE WITH
PRINCIPAL USES (4) AS LISTED UNDER "R-t' SINGLE-FAMILY RESIDENTIAL, TO
ALLOW A PRIMARY AND SECONDARY SCHOOL, FOR THE PROPERTIES
LOCATED AT APPROXIMATELY 1742 AND 1744 SOUTHWEST 2ND AVENUE, AND
TWO UNASSIGNED ADDRESSES, HAVING FOLIO NUMBERS 01-4139-008-0070
AND 01-4139-008-0060 AND 1737 AND 1745 SOUTHWEST 2ND COURT, AND TWO
UNASSIGNED ADDRESSES, HAVING FOLIO NUMBERS 01-4139-008-0080 AND 01-
4138-001-5550, LEGALLY DESCRIBED AS EXHIBIT "A" (HEREBY ATTACHED),
PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; ZONED "O" OFFICE. THIS
SPECIAL EXCEPTION WAS GRANTED PER PLANS ON FILE WITH A TIME
LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE
OBTAINED, SUBJECT TO THE FOLLOWING CONDITIONS AS DESCRIBED IN
EXHIBIT "1" (HEREBY ATTACHED).

Lots 1 and 2, Block 1, CATHERINE'S PLACE, according to the Plat thereof, as recorded
in Plat Book 162, Page 92, of the Public Records of Miami -Dade County, Florida.
AND
Lot 16 of Block 33 as shown on an unrecorded Plat in the possession of MARY
BRICKELL entitled "Plat of a part of the City of Miami" known as the second amended
Plat of South Miami by FREDERICK and BROWN civil engineers dated March AD
1911, being a part of the Polly Lewis Donation in Section 39, Township 54 South, Range
41 East; the same being more particularly described as follows to wit: Begin at the
Southeasterly corner of Lot 5, Block 28, HOLLEMAN PARK as recorded in Plat Book 8,
Page 23, of the Public Records of Dade County, Florida; thence run Southeasterly 150
feet along the southeasterly extension of the northeasterly line of said Lot 5 to the
northwesterly line of S.W. 2" d Avenue; thence run southwesterly 50 feet along the
northwesterly line of S.W. 2"d Avenue, the same being parallel with the northwesterly
line of said Lot 5; thence run northwesterly 150 feet along the southwesterly extension of
the southwesterly line of said Lot 5; thence run northwesterly 50 feet along the
southwesterly line of said Lot 5 to the point of beginning.

said Block 28, thence northwesterly 88,54 feet along said line dividing Lots 6 and 5 to
Southwest 2" � Court, thence 52°23'14" west 50 feet along Southwest 2" Court to the
point of beginning.

EXHIBIT 1
The Zoning Board approved the application with the following conditions:
1) During all pre -enrollment periods preference shall be given to students who live
within a three mile radius of the Charter School and this Preference will be
maintained by giving at least 80% of the student stations to students who live
within a three mile radius of the Charter School;
2) No more than 30 students will be allowed to drive themselves or other students in
motor vehicles to or from the Charter School at any one time;
3) A permanent membership seat shall be established and maintained for a
representative of the Roads Homeowners Association on the Charter School's
Educational Excellence Advisory Committee on or before the inception of this
Committee;
4) These conditions are additional conditions and safeguards included in this
Special Exception and will additionally be included in a Covenant running with
the land Voluntarily Proffered by the Applicant which will be submitted by the
Applicant, with attached Exhibit "A" or included legal description for the Property,
to the Zoning Administrator within 30 days of this approval. The covenant shall
be subject to review and acceptance by the Zoning Administrator and, once
accepted, will be recorded by the Applicant in the public records of Miami -Dade
County. The applicant shall furnish the Zoning administrator with a recorded
copy.
The Planning Department recommended approval of the application as presented
with the following conditions:
1. This Special Exception is subject to record in the Public Records a Unity of Tile
or a covenant in lieu of a Unity of Title.
2. The applicant shall present revised plans for review and approval by the Planning
Department prior to the issuance of any building permits including:
Urban Design:
a. Provide wider sidewalk along all street frontage.
b. Provided pedestrian and bicycle connections to nearby neighborhoods and
where bicycle parking will be located.
c. Dimensions of curb cuts should be reduced to the minimum required widths by
code.
Architecture:
a. All sides of the proposed parking garage shall be provided with a screening material
or designed in a manner to avoid light spillover and prevent views of cars and
mechanical equipment from the street front and neighboring properties.
b. Provide material sample or photograph of all proposed garage screening materials.
Landscape:
a. Provide a complete landscape plan including a continuous canopy of shade trees
along all street frontages.
