HomeMy WebLinkAboutLegislation (Version 2) 03-24-11City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00108 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THAT THE PERMANENT VEHICULAR ACCESS RESTRICTION BARRICADES LOCATED AT NORTHEAST 72ND TERRACE, NORTHEAST 73RD STREET, NORTHEAST 74TH STREET, NORTHEAST 75TH STREET AND NORTHEAST 77TH STREET AT THE EASTERLY SIDE OF THEIR INTERSECTION WITH NORTHEAST 6TH COURT, MIAMI, FLORIDA, BE ADDITIONALLY DESIGNATED TO PROHIBIT EMERGENCY VEHICLE ACCESS THROUGH SAID BARRICADES, IN ACCORDANCE WITH ALL APPLICABLE LAWS; SUBJECT TO THE APPROVAL OF THE MIAMI-DADE COUNTY TRAFFIC DIRECTOR AND TO CERTAIN CONDITIONS AS MORE PARTICULARLY SET FORTH HEREIN. WHEREAS, on April 10, 1986, the City Commission adopted Resolution No. 86-291 directing the permanent prohibition of vehicular access to certain streets in the Belle Meade neighborhood, subject to certain conditions; and WHEREAS, a condition of approval of said prohibition of vehicular access is that access for emergency vehicles be allowed at all times through said barricades; and WHEREAS, at a meeting held on October 12, 2010 at Legion Park, a petition was circulated to all Belle Meade property owners in attendance, and a majority of the signatures indicate a vote for approval of the installation of metal picket fences across each of the five existing barricades for the purpose of additionally deterring access to and from the Belle Meade neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission directs that emergency vehicle access be additionally prohibited through the permanent vehicular access restriction barricades located at Northeast 72nd Terrace, Northeast 73rd Street, Northeast 74th Street, Northeast 75th Street and Northeast 77th Street at the easterly side of their intersection with Northeast 6th Court, Miami, Florida, subject to the following conditions: a) approval of the Miami -Dade County Traffic Director; b) said restriction of access shall be accomplished by the installation of a six (6) foot tall metal picket fence installed in and across each of the five existing vehicular access restriction barricades extending from the face of the sidewalk on one side of the roadway to the face of sidewalk on the opposite side of the roadway; c) the Department of Public works shall approve the design of the aforesaid fence; d) said fence shall not prohibit pedestrian and bicycle access; and City of Miami Page 1 of 2 File Id: 11-00108 (Version: 2) Printed On: 2/28/2011 File Number. 11-00108 e) all applicable laws. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1 } If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
