HomeMy WebLinkAboutPre ResolutionsJ-91-477 6/4/91 RESOLUTION NO. 91. 4128 A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE ACQUISITION AND EXECUTE A PURCHASE AND SALE AGREEMENT IN A FORM ACCEPTABLE TO THE CITY ATTORNEY WITH THE PROPERTY OWNER(S) FOR ACQUISITION OF FIVE (5) PARCELS (TOTAL OF 1.5 ACRES) IN THE MODEL CITY COMMUNITY DEVELOPMENT TARGET AREA (MORE PARTICULARLY DESCRIBED IN ATTACHED EXHIBITS "A" AND "B") TO BE USED FOR THE DEVELOPMENT OF .HOUSING IN CONNECTION WITH THE CITY'S AFFORDABLE HOUSING DEVELOPMENT PROGRAM; ALLOCATING FUNDS THEREFOR IN AN AMOUNT NOT TO EXCEED THREE HUNDRED FORTY THOUSAND DOLLARS ($340.,000) FROM THE 1976 HOUSING GENERAL OBLIGATION BONDS AUTHORIZATION UNDER THE "AFFORDABLE HOUSING PROGRAM", PROJECT NUMBER 321024, INDEX CODE 599101, FOR ACQUISITION OF THE SUBJECT PARCELS; AUTHORIZING THE CITY ATTORNEY TO PROCEED TO CLOSE ON THE SUBJECT PARCELS AFTER EXAMINATION OF THE ABSTRACT AND CONFIRMATION OF OPINION OF TITLE; AND APPROVING, IN PRINCIPLE, SUBSEQUENT TRANSFER OF THE SUBJECT PARCELS TO THE URBAN LEAGUE OF GREATER MIAMI, INC., FOR DEVELOPMENT .OF A LOW -DENSITY LOW AND MODERATE INCOME AFFORDABLE RENTAL HOUSING PROJECT, SUBJECT TO. WHEREAS,; there exists a severe shortage of standard housing in the City of.Miami affordable to families and individuals of low and.moderate income; and WHEREAS,. the, City Commission recognizes:.thatparticipation of both the public and private sector is necessary to foster the development of housing:. affordable to families and individuals;. and ..WHEREAS, the. City has, an interest low. and.moderate :income in acquiring- suitable housingdevelopment sites in the Model City neighborhood in connection with the development . of new housing...resource, affordable to.low..and moderate: income families•and•,:individuas in the City; and. . Section 3. 1976 Housing General Obligation Sends Authorization land acquisition funds which exist as an available balance previously authorized by the 'City Commission (Project Number.. 321024, Index Code 599101), are hereby designated and allocated:in an amount not to exceed $340,000 to defray the cost of said acquisition. Section 4. The City Attorney is hereby authorized to proceed to close on said properties after examination of the abstract:and conformation of an Opinion of Title. If approved by the City Attorney, the City Manager is hereby authorized to execute the Agreement of Purchase and Sale and any other related documents if .necessary, to disburse the allocated City funds in accordance with the City Commission's authorization. Section 5. •The designation of Urban League of Greater Miami,. inc., a not -for -profit corporation, as a sponsor. to undertake :the .subsequent development of an affordable rental housing development on the said parcels to be acquired:by the City;',i:deritified in Exhibits "A" and "B", attached hereto,. subject to the Urban League of Greater Miami, Inc. providing evidence acceptable to the City of a firm commitment for project construction and permanent financing, is hereby approved,•:in:.. principle. Urban League of Greater Miami, Inc. has been successful An developing .a thirty (30). unit townhame project in cooperation.with the City of Miami on a'1.2 acre parcel donated to the not -for -profit corporation by the City in July of 1986. The $1.3 million. rental •project, M .6 M Matson, located at 1521 Northwest 61st Street in the Model City neighborhood is indicative of the City's commitment • to promoting the production of affordable housing in the City of Miami through various public -private sector sponsored housing ventures. Based on an appraisal report prepared by Mr. Moses C. Florence, C.R.R., it has been determined that the fair market value of the five (5) parcels is presently $340,000. The attached resolution authorizes the' City Manager to negotiate the acquisition and execute a purchase and sale 'agreement with the property owner(s) for acquisition .of the aforementioned parcels. The attached resolution further establishes $340,000 as the upper limit in which the City would negotiate with the property owner(s) for acquisition of the subject parcels. The City is in a position to assist the private sector in the` production. of new rental housing within the affordability range -of low and moderate income families in the Model City neighborhood with the acquisition of the said five (5) parcels and by'making.the development site, capable of supporting approximately eighty.(80)". units.based on the current zoning, available for such development.- In. an attempt to further •stimulate the development of new affordable rental housing units in the City, City Commission c. ratification of•the attached resolution'is recommended. ("Progressive") is developing a project know as Friendship Village, a 160 unit affordable rental housing development, including ground floor retail and parking ("Project"); and WHEREAS, the Administration has recommended the conveyance to Progressive of certain City of Miami ("City") owned parcels, as specified on Exhibit "A" ("Property"), for the development of the Project; and WHEREAS, the Purchase and Sale Agreement(s) for the sale of the Property to Progressive will be contingent upon Progressive obtaining an award of Low Income Housing Tax Credits for the Project from the Florida Housing Finance Corporation, and will have an expiration date of December 31, 2007; and WHEREAS, it is anticipated that Progressive will assign the Purchase and Sale Agreement(s) with the City to certain other companies for the development of the Project; and WHEREAS, any cost associated with the project/Property paid by the City, will be reimbursed back to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The sale to Progressive of certain City -owned parcels, as specified in "Exhibit A," attached and incorporated, is approved. Section 4. Progressive is authorized to assign such Purchase and Sale Agreements(s) subject to the prior consent of the City Manager. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. WHEREAS, the approval of a Sale and Purchase Agreement ("Agreement") for the sale of certain City of Miami ("City") owned parcels, to Progressive Vision CDC ("Developer") will have an expiration date of December 31, 2007, and will be contingent upon the Developer obtaining a tax credit award for the parcels, as described in "Exhibit A," attached and incorporated; and WHEREAS, any cost associated with the project paid by the City, will be reimbursed back to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The purchase and sale of certain City -owned parcels, to the Developer, as specified in "Exhibit A," attached and incorporated, is approved. Section 3. The City Manager is authorized {1} to execute an Agreement, and to consummate such other documents as may be necessary to consummate such transaction in accordance with the terms and conditions of the Agreement, which terms may be amended by the City Manager as may be necessary in order to meet the best interests of the City. Section 4.
