A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO GRANTALLAPATTAH BUSINESS
DEVELOPMENT AUTHORITY, INC. ("ABDA"), AN EXTENSION OF TIME TO
COMMENCE CONSTRUCTION FROM DECEMBER 31, 2009 TO JUNE 1, 2011,
AND TO COMPLETE CONSTRUCTION FROM DECEMBER 31, 2010 TO
DECEMBER 31, 2011, ON THE PROPERTY LOCATED AT 1264 NORTHWEST
31ST STREET, MIAMI, FLORIDA, AND AN EXTENSION OF TIME TO COMMENCE
CONSTRUCTION FROM JUNE 30, 2010 TO JANUARY 1, 2012, AND TO
COMPLETE CONSTRUCTION FROM JUNE 30, 2011 TO JUNE 30, 2012, ON THE
PROPERTY LOCATED 790 NORTHWEST 29TH TERRACE, MIAMI, FLORIDA;
AND AN EXTENSION OF TIME TO COMMENCE CONSTRUCTION FROM JUNE
30, 2010 TO JULY 1, 2012, AND TO COMPLETE CONSTRUCTION FROM JUNE
30, 2011 TO DECEMBER 30, 2012, FOR THE PROPERTIES LOCATED AT 3255
NORTHWEST 11TH COURT AND 3245 NORTHWEST 11TH COURT, MIAMI,
FLORIDA, LEGALLY DESCRIBED IN EXHIBIT "A," ATTACHED AND
INCORPORATED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE
ANY REQUIRED MODIFICATIONS TO THE DEED(S) THAT CONVEYED THE
PROPERTIES FROM THE CITY OF MIAMI TO ABDA, AND ALL OTHER
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PURPOSES.
WHEREAS, pursuant to Resolution No. 03-215, adopted February 27, 2003, the Miami City
Commission approved the conveyance of two City of Miami ("City") owned vacant parcels located at
2374 Northwest 33rd Street, and 790 Northwest 29th Terrace, Miami, Florida, to Allapattah Business
Development Authority, Inc. ("ABDA"), a not -for -profit Florida corporation, for the development of two
(2) new single-family homes for low and moderate -income families and individuals; and
WHEREAS, pursuant to Resolution No. 04-0289, adopted May 6, 2004, the Miami City
Commission designated certain City -owned properties located at 3245 Northwest 11th Court, 3255
Northwest 11th Court, and 1264 Northwest 31st Street, Miami, Florida, as surplus and authorized
ABDA to develop three (3) twin homes for affordable to very low, low or moderate -income families or
individuals; and
WHEREAS, ABDA has completed one (1) single family house located at 2374 Northwest 33rd
Street, Miami, Florida; and
WHEREAS, pursuant to Resolution No. 07-0490, adopted September 11, 2007, the Miami City
Commission granted ABDA and extension until March 30, 2008, to commence construction on the
properties located at 1264 Northwest 31st Street, 3245 Northwest 11th Court, 3255 Northwest 11th
Court and 790 Northwest 29th Terrace, Miami, Florida, and also granted an extension until December
31, 2008, to complete construction of a twin home on each property and authorized the construction of
a twin home rather than a single family home on the property located at 790 Northwest 29th Terrace,

Miami, Florida; and
WHEREAS, pursuant to Resolution No. 08-0251, adopted May 8, 2008, ABDA was granted an
extension of time from March 30, 2008 to October 31, 2008, to commence construction on the
properties located at 1264 Northwest 31st Street, 3245 Northwest 11th Court, 3255 Northwest 11th
Court and 790 Northwest 29th Terrace, Miami, Florida, and an extension from December 31, 2008 to
December 31, 2009, to complete construction; and
WHEREAS, pursuant to Resolution No. 09-0028, adopted January 15, 2009, ABDA was granted
an extension of time to commence construction from October 31, 2008 to December 31, 2009, and to
complete construction from December 31, 2009 to December 31, 2010, on the property located at
1264 Northwest 31st Street, Miami, Florida; and an extension of time to commence construction from
October 31, 2008 to June 30, 2010, and to complete construction from December 31, 2009 to June 30,
2011, on the properties located at 3245 Northwest 11th Court, 3255 Northwest 11th Court and 790
Northwest 29th Terrace, Miami, Florida; and
WHEREAS, ABDA has obtained the required permits and has selected a contractor for the
property located at 1264 Northwest 31st Street, Miami, Florida; and
WHEREAS, due to delays incurred by the private bank providing construction costs in processing
their loan application, ABDA is requesting an extension of construction commencement and
completion dates on the properties described in Exhibit "A", attached and incorporated; and
WHEREAS, the City Administration recommends granting ABDA an extension of time to
commence construction from December 31, 2009 to June 1, 2011, and to complete construction from
December 31, 2010 to December 31, 2011, on the property located at 1264 Northwest 31st Street,
Miami, Florida; and an extension of time to commence construction from June 30, 2010 to January 1,
2012, and to complete construction from June 30, 2011 to June 30, 2012, on the property located
790 Northwest 29th Terrace, Miami, Florida; and an extension of time to commence construction from
June 30, 2010 to July 1, 2012, and to complete construction from June 30, 2011 to December 30,
2012, for the properties located at 3255 Northwest 11th Court and 3245 Northwest 11th Court, Miami,
Florida, legally described in Exhibit "A", attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1) to grant ABDA an extension of time to commence
construction from December 31, 2009 to June 1, 2011, and to complete construction from December
31, 2010 to December 31, 2011, on the property located at 1264 Northwest 31st Street, Miami, Florida;
and an extension of time to commence construction from June 30, 2010 to January 1, 2012, and to
complete construction from June 30, 2011 to June 30, 2012, on the property located 790 Northwest
29th Terrace, Miami, Florida; and an extension of time to commence construction from June 30, 2010
to July 1, 2012, and to complete construction from June 30, 2011 to December 30, 2012, for the
properties located at 3255 Northwest 11th Court and 3245 Northwest 11th Court, Miami, Florida,
legally described in Exhibit "A", attached and incorporated.

Section 3. It is the intention of the Miami City Commission that title to the parcels described above
and in Exhibit "A," attached and incorporated, shall be deemed to have remained in ABDA from the
date of conveyance.
Section 4. The City Manager is -authorized {1} to execute any required modifications to the deed(s)
that conveyed the properties from the City to ABDA, and all necessary other documents, in a form
acceptable to the City Attorney for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1) The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
