HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00247 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER A PUBLIC HEARING, PURSUANT TO SECTION 2-614 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), WAIVING THE CONFLICT OF INTEREST PROVISIONS CONTAINED IN SECTION 2-612 OF THE CITY CODE, TO ENABLE MIRTA "MIKKI" PADRON CANTON TO ENTER INTO AN AGREEMENT WITH THE CITY OF MIAMI, FOR THE PURPOSE OF SERVING AS SENIOR PUBLIC POLICY ADVISOR TO THE MAYOR. WHEREAS, the City Manager wishes to retain Mirta "Mikki" Padron Canton to advise the City of Miami ("City") regarding public -private economic development partnerships and international alliances, and intergovernmental affairs; and WHEREAS, Section 2-612 of the Code of the City of Miami, Florida, as amended ("City Code"), prohibits a family member of an employee of the City from entering into a contract or transacting any business with the City; and WHEREAS, Section 2-614 of the City Code allows the City Commission to waive such prohibitions if certain specific findings are made by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The prohibitions contained in Sections 2-612 of the City Code, are waived pursuant to Section 2-614 of the City Code, by a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a public hearing, as such prohibitions pertain to Mirta "Mikki" Padron Canton. Section 3. The waiver set forth in Section 2 hereof is based upon the following findings: (a) Mirta "Mikki" Padron Canton's services to advise the City as Senior Public Policy Advisor to the Mayor regarding public -private economic development partnerships and international alliances, and intergovernmental affairs are unique and the city cannot avail itself of such services without entering into a transaction which would violate this section but for waiver of its requirements; and (b) Mirta "Mikki" Padron Canton's services are in the best interest of the City. Section 4.
