District Impacted: 2 Emergency Ordinance ❑ Discussion Item Law Department Matter ID No. 11-1 Purpose of Item: A Resolution of the Miami City Commission, authorizing the City Manager to execute a Third Amendment to the Lease Agreement ("Third Amendment"), between the City of Miami ("City" or "Lessor") and Rickenbacker Marina, Inc., a Florida Corporation ("Lessee"), for property located at 3301 Rickenbacker Causeway, Miami, Florida ("Property"), to modify the legal description of a portion of the submerged lands for the purpose of providing said lease area to Biscayne Bay Restaurant Corporation d/b/a Rusty Pelican ("Rusty Pelican") necessary to comply with capital improvements required by the City, approved in their Amendment No. 3, with additional terms and conditions as more particularly set forth in the Third Amendment. Director City Manager Page 1 of 2 N/A Subject: Third Amendment to Lease Agreement between City of Miami and Rickenbacker Marina, Inc., for city -owned property located at 3301 Rickenbacker Causeway, Miami, Florida. Background Information: The City of Miami ("City" or "Lessor") and Rickenbacker Marina, Inc. ("Lessee") obtained a new topographical survey of the Property for Lessee to proceed with their capital improvements, which determined that a portion of the submerged lands of Biscayne Bay Restaurant Corporation d/b/a Rusty Pelican's ("Rusty Pelican") lease area is located within Lessee's submerged land lease area. The City and Lessee are requesting a modification of a portion of the legal description for the submerged lands to favor Rusty Pelican, so that Rusty Pelican can complete capital improvements approved in their Amendment No. 3.
