HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00118 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO ISSUE A PERMIT TO AN APPLICANT CONTRACTOR TO TEMPORARILY OPEN ONE OR MORE VEHICULAR ACCESS STREET CLOSURES IN THE SHORECREST NEIGHBORHOOD, MIAMI, FLORIDA, TO ALLOW FOR LOCAL TRAFFIC ACCESS TO PRIVATE PROPERTIES FOR A PERIOD OF TIME NOT TO EXCEED THIRTY (30) DAYS, SUBJECT TO THE APPROVAL OF THE MIAMI-DADE COUNTY TRAFFIC DIRECTOR AND TO CERTAIN CONDITIONS AS MORE PARTICULARLY SET FORTH HEREIN. WHEREAS, on March 27, 1995, the City Commission adopted Resolution No. 95-248 directing the permanent prohibition of vehicular access to certain streets in the Shorecrest neighborhood, Miami, Florida, subject to certain conditions; and WHEREAS, there is a sanitary sewer force main project under construction within the City of Miami ("City") limits from North Bayshore Drive to Northeast 7th Avenue along Northeast 80th Street, Miami, Florida, that will serve the entire municipality of North Bay Village; and WHEREAS, a number of residents will be unable to access their property due to the combination of construction road closures and the existing street barricades; and WHEREAS, the existing barricades numbered 4, 5, 6, and 12, shown on Plan "A", attached and incorporated, may be temporarily opened to allow for local traffic, City service vehicle, school bus, and emergency vehicle access; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission authorizes the Director of Public Works to issue a permit to an applicant contractor to temporarily open one or more vehicular access street closures in the Shorecrest neighborhood, Miami, Florida, to allow for local traffic access to private properties for a period of time not to exceed thirty (30) days, subject to the following conditions: a) approval of the Miami -Dade County Traffic Director; b) the Director of the Department of Public works or his designee shall approve the design and maintenance of traffic plan; and c) compliance with all applicable laws; and d) required insurance, bonding and hold harmless/indemnity. BR Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
