HomeMy WebLinkAboutCC Legislation (Version 2)City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01454zt Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114, THE MIAMI 21 CODE, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BYAMENDING ARTICLE 5. "SPECIFIC TO ZONES," TO MODIFY STORY HEIGHT MAXIMUM FOR THE T4 TRANSECT ZONE, CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City Commission adopted the Miami 21 Code ("Code"), Ord. 13114; and WHEREAS, the Code establishes regulations for measurement of height in all Transect Zones; and WHEREAS, it has been determined the T4 Transect Zone should be amended to establish a maximum height of forty (40) feet; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its citizens to amend its Zoning Ordinance as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance 13114, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by making modifications to Article 5 of the Code in the following particulars: {1} "ARTICLE 5. SPECIFIC TO ZONES 5.4 GENERAL URBAN TRANSECT ZONES (T4) 5.4.2. Building Configuration (T4) * * * * * * f. Building Heights shall be measured in Stories and shall conform to Article 4, Table 2 and be as City of Miami Page 1 of 2 File Id: 10-01454zt (Version: 2) Printed On: 1/13/2011 File Number.' 10-01454zt shown in Illustration 5.4. The first -floor Elevation of a Principal Building shall be at average Sidewalk grade; a first -floor Residential or Lodging Function should be at a minimum Height of two (2) feet and a maximum Height of three and a half (3.5) feet for privacy reasons or as regulated by FEMA, whichever is higher. The height of the building shall be a maximum of three (3) Stories and forty (40) feet to the top of the roof slab. ILLUSTRATION 5.4 GENERAL URBAN TRANSECT ZONES (T4) * * * BUILDING HEIGHT a. Principal Building 3 Stories max. and 40 ft. max. b. Outbuilding 2 Stories max. [See Exhibit A] * * * Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Miami 21 Code of the City of Miami, Florida, which provisions may be renumbered or reentered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 6. This Ordinance shall become effective upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
