The following terms and conditions are incorporated into and form a port of the Construction
Agreement, dated , between the State of Florida, Department of Transportation, 1000
N.W..lllm Avenue' Miami, FL 33172 (hereinafter referred to as the "DEPARTMENT") and the City of
Miami ' a Florida municipal corporation located in Miami -Dade County, (hereinafter referred to as the
"Construction Coordinator").
Addendum Controlling. In the evert there is a conflict between the terms and conditions of the
Agreement orany attachments, exhibits oraddenda thereto and this Addendum, this Addendum shall
The following language will be added as Paragraphs 31 and 32:
31. Nothing in this agreement shall be deemed or otherwise interpreted aswaiving the Construction
'Coordinator's sovereign immunity protections, or as increasing the limits of liability as set forth in
Section 7682D,Florida Statutes.
32. The hold harmless and indemnity given by the Construction Coordinator in the Agreement is
subject to the limitations of Section 768.28. Florida Statutes, and /s limited to the negligent acts or
omissions of the Construction Coordinator in the performance of this Agreement.
