HomeMy WebLinkAboutR-11-0055City of Miami Legislation Resolution: R-11-0055 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00064 Final Action Date: 2/10/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENTS TO THE AUCTION SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI AND FISHER AUCTION CO., INC., AND THE INTERNET AUCTION SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI AND LONE STAR AUCTIONEERS, INC., IN SUBSTANTIALLY THE ATTACHED FORM(S), FOR THE AUCTIONING OF AUTOMOBILES (SURPLUS AND CONFISCATED/FOUND), TRUCKS, FIRE -FIGHTING EQUIPMENT AND VEHICLES, HEAVY EQUIPMENT, BOATS, WORK EQUIPMENT, PERSONAL AND MAINFRAME COMPUTERS, OFFICE EQUIPMENT, FURNITURE, JEWELRY, ELECTRONICS, MISCELLANEOUS POLICE CONFISCATED ITEMS AND FOUND PROPERTY, PURSUANT TO RESOLUTION NO. 06-0110, ADOPTED FEBRUARY 23, 2006, TO INCLUDE AN ADDITIONAL ONE (1) YEAR RENEWAL OPTION, IN AN EFFORT TO AVOID AN INTERRUPTION OF ON -SITE AND INTERNET AUCTION SERVICES WHILE A NEW REQUEST FOR PROPOSALS IS BEING SOLICITED, EVALUATED, AND AWARDED. WHEREAS, on February 23, 2006, the City Commission adopted Resolution No. 06-0110, accepting the recommendation of the City Manager approving the findings of the evaluation committee, pursuant to Request for Proposals ("RFP") No. 04-05-137, that the top -ranked firm to provide On -Site Auction Services is Fisher Auction Co., Inc. and that the top -ranked firm to provide Internet Auction Services is Lone Star Auctioneers, Inc.; and WHEREAS, said Resolution authorized the City Manager to negotiate and execute Professional Services Agreements ("Agreements"), in substantially the attached form(s), with said firms, on an as -needed basis, for a three (3) year period, with the option to extend for two (2) additional one (1) year periods, subject to the terms and conditions as stated in said Agreements; and WHEREAS, the Auction Services Agreement executed between the City of Miami ("City") and Fisher Auction Co., Inc., for On -Site Auction Services is set to expire on February 26, 2011, with no more additional options for renewal, and the Internet Auction Services Agreement executed between the City and Lone Star Auctioneers, Inc., is set to expire on February 23, 2011, with no more additional options for renewal; and WHEREAS, in an effort to avoid an interruption of On -Site and Internet Auction Services, it is now necessary to amend both Agreements to allow for an additional one (1) year renewal option, while a new RFP is being solicited, evaluated, and awarded; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 11-00064 (Version: 1) Printed On: 9/27/2017 File Number: 11-00064 Enactment Number: R-11-0055 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute amendments to the Auction Services Agreement between the City and Fisher Auction Co., Inc., and the Internet Auction Services Agreement between the City and Lone Star Auctioneers, Inc., in substantially the attached form(s), for the auctioning of automobiles (surplus and confiscated/found), trucks, fire -fighting equipment and vehicles, heavy equipment, boats, work equipment, personal and mainframe computers, office equipment, furniture, jewelry, electronics, miscellaneous police confiscated items and found property, pursuant to Resolution No. 06-0110, adopted February 23, 2006, to include an additional one (1) year renewal option, in an effort to avoid an interruption of on -site and internet auction services while a new RFP is being solicited, evaluated, and awarded. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
