Background Information:
A parcel of land located between the private properties with addresses of 621 Northeast 61 Si Street and 623
Northeast 61" Street is identified as an alley on the plat of the neighborhood entitled "White's Lemon City,"
recorded on May 16, 1893. The alley is located east of Biscayne Boulevard and "dead -ends" 100 feet north
of its intersection with Northeast 61" Street. The alley has never been improved for public access and does
not interconnect or provide circulation with the roadway network. The alley is not identified as a right of
way on the City's official Atlas of Municipal Streets and is not shown at all on the current or former Zoning
Atlas. There are no plans or records for the alley on file in the Public Works Department that indicate there
was ever any maintenance or construction of the alley by the City and no documents indicating any
requirement or actual usage of the alley as public right of way.
Evenly divided portions of the alley are included in the warranty deeds for the private properties at 621
Northeast 61" Street and 623 Northeast 61" Street and the City has accepted ad valorem taxes for the alley
from both of the private property owners.
The City has further acknowledged that it does not own or otherwise have jurisdiction for the alley by the
request and acceptance of a quitclaim deed dated November 16, 1959 from the private property owner on the
west side of the alley for a four (4) foot wide portion of the alley along Northeast 61 S` Street for sidewalk
purposes.
