A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AFTER A DULY NOTICED PUBLIC HEARING, APPROVING THE SEVENTH
AMENDMENT TO SERIES 2005 CONTRACT SPECIFIED/PERCAPITA CONTRACT
EXTENSION, IN SUBSTANTIALLLYTHE ATTACHED FORM, ("SEVENTH
AMENDMENT") TO THE ORIGINAL SERIES 2005 SAFE NEIGHBORHOOD
PARKS BOND PROGRAM AGREEMENT, AS SUBSEQUENTLY AMENDED, WITH
MIAMI-DADE COUNTY OFFICE OF CAPITAL IMPROVEMENTS, HEREBY
EXTENDING, CONTINUING, AND AMENDING THE LAST COMPLETION DATE
AND EFFECTIVE TERM OF THE EXISTING AMENDED AGREEMENT FROM
JUNE 5, 2010 TO JUNE 30, 2011, WITH SAID SEVENTH AMENDMENT
COVERING REIMBURSEMENTS TO THE CITY OF MIAMI ("CITY") FOR
PREVIOUSLY COMPLETED PROJECTS AT THE CITY'S CURTIS PARK, LUMMUS
PARK, AFRICAN SQUARE PARK, AND VIRGINIA KEY BEACH PARK;
AUTHORIZING THE CITY MANAGER TO EXECUTE THE SEVENTH AMENDMENT
AND ALL OTHER NECESSARY DOCUMENTS, AFTER CONSULTATION WITH
THE CITY ATTORNEY, FOR SAID PURPOSES.
WHEREAS, in 1996 the citizens of Miami -Dade County ("County") authorized the issuance of
General Obligation Bonds (Safe Neighborhood Parks Bonds) for the purpose of financing capital
improvements for certain parks, beaches, natural areas and recreational facilities; and
WHEREAS, the Safe Neighborhood Parks Bond ("SNPB") Program was officially adopted on July
16, 1996, pursuant to County Ordinance No. 96-115, listing all projects and their respective scopes of
work; and
WHEREAS, the City of Miami ("City") subsequently entered into six amendments to the original
SNPB Program agreement with the County and completed, among other City SNPB Program projects,
projects at Curtis Park, Lummus Park, African Square Park and Virginia Key Beach Park, and
subsequently submitted the required reimbursement requests to the County prior to June 5, 2010, the
last completion date as stated in the existing amended agreement; and
WHEREAS, although the City completed said projects prior to June 5, 2010, the last effective term,
the County requires the City to approve the Seventh Amendment to the existing agreement for the
purposes of extending, continuing, and amending the completion date to June 30, 2011, in order to
allow the County to complete their legislative process which, is necessary to amend the original SNPB
Ordinance 96-115 covering all scope changes to various County -wide SNPB projects and to complete
reimbursements to the City for the projects at Curtis Park, Lummus Park, African Square Park, and
Virginia Key Beach Park;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. After a duly noticed public hearing, the Seventh Amendment to Series 2005 Contract
Specified/Per Capita Contract Extension, in substantially the attached form, ("Seventh Amendment") to
the original Series 2005 Safe Neighborhood Parks Bond Program, as subsequently amended, with
Miami -Dade County Office of Capital Improvements, is approved hereby extending, continuing, and
amending the last completion date and effective term of the existing amended agreement from June 5,
2010 to June 30, 2011, with said Seventh Amendment covering reimbursements to the City of Miami
("City") for previously completed projects at the City's Curtis Park, Lummus Park, African Square Park,
and Virginia Key Beach Park.
Section 3. The City Manager is authorized{1} to execute the Seventh Amendment and all other
necessary documents, after consultation with the City Attorney, for said purposes.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
