submitted by Apollo Development Corp. in relation to the referenced property.
As an area resident, I am very familiar with the existing building on the property
and can attest to the fact that the ground floor retail has now been vacant for
over six months.
The proposed lounge would provide a neighborhood resource and would
be reflective of the Biscayne Boulevard renaissance as it continues north. It is also
significant to note that, unlike other small retail uses along the Boulevard, this
property benefits from a considerable amount of adjacent off street parking.
I have met with the applicants, reviewed their proposed plan and I
support their application. Accordingly, I urge the Planning Department and the

Dear Mr. Hans,
This report is intended to summarize the results of sound transmission tests conducted on the above referenced property
the evening of Sunday, January 2, 2011, between the hours of 9:00 p.m. and 1:00 a.m. the following day. The tests
were performed to analyze and quantify the radiation characteristics of sound generated within the property to the
surrounding neighborhood, in particular the residential properties located to the East of the subject property.
The process used to assess sound propagation in this type situation is as follows. A sound system capable of generating
very high sound pressure levels (SPL) is placed within the structure being examined. A specific test signal called Pink
Noise is played through the system. Using a combination sound level meter (SLM) and real-time audio spectrum
analyzer (RTA), the system's output is adjusted to a generate a sound pressure level of 100 decibels (dB) within the
space. This data is measured and stored for future reference. Music program material played at the reference level is
then substituted for the pink noise source to have a more easily identified signal when testing outside the building.
The measurement system is then taken outside the building and measurements are made around the perimeter to assess
any sound that leaks from the building, paying particular attention to doors and windows. It is these openings that are
most susceptible to sound leaks and therefore of prime interest during the process. Indeed, as doors provide entry and
egress to buildings and are subject to being open, it is important to consider these openings. More on that later.
Specific to this property, we were charged with determining whether music played within the building would be audible
at the residential properties to the East. Sections 36-4 and 36-5 of the City of Miami Noise Ordinance specify that:
"It shall be unlawful for any person owning, occupying or having charge of any building or premises or any part
thereof, in the city, at any time to cause or suffer or allow any loud, unnecessary, excessive or unusual noises in
the operation of any radio, phonograph or other mechanical sound -making device or instrument, or reproducing
device or instrument, or in the playing of any band, orchestra, musician or group of musicians, or in the use of
any device to amplify the music of any band, orchestra, musician or group of musicians, where the noise or music
is plainly audible at a distance of 100 feet from the building, structure, vehicle or premises in which or from
which it is produced. The fact that the noise or music is plainly audible at a distance of 100 feet from the vehicle
or premises from which it originates constitutes prima facie evidence of a violation of this chapter."

We then set about the process of determining if sound within the structure would be "plainly audible" 100 feet from
the East entrance to the building. Measurements were taken just outside the East entrance as a reference, location 1 as
shown in Figure 1 below. Additional test locations are also shown in Figure 1. These are:
1. Reference sound level outside East entrance (80.8 dB SPL measured)
2. the property line which separates the parking lot associated with the subject building and the property
addressed 631 NE 82nd Street (57.2 dB SPL predicted)
3. the property line which separates the eastern -most parking lot and the property at 655 NE 82"d Street (50.6
dB SPL predicted)
4. the NE corner of the parking lot adjacent to the residential properties at 655 NE 82nd Street and 644 NE 82"d

The sound levels referred to as "SPL predicted" were generated using a computer -assisted sound propagation modeling
program called EASE Address. This modeling program, used in conjunction with satellite photographs of the area
under investigation, allows the investigation into how sound expands into an area and the prediction of sound levels
at various distances from the sound source. In this case, the sound level measured outside the entrance to the building
was used in the simulation. Markers placed on the area map show the resulting predicted sound level at each location
of interest. These levels are then compared with measured data obtained during the sound transmission test. Comparing
the measured and predicted levels allows one to determine whether the test signal generated within the structure is
influencing the environment. Figure 2 shows sound pressure levels superimposed on the map of the area, in the same
manner as temperatures are displayed on satellite maps by weathermen on the news. The color scale illustrates changes
in sound level rather than temperature.

This predictive technique is possible due to one of the laws of physics; the Inverse Square Law, commonly referred to
as the "inverse square law change in level." Gravity, light and many other physical effects exhibit this rate of change
with varying distance from a source.
Applied to acoustics, the inverse square law change in level states that for any doubling of distance from a source, the
sound level will decrease by 6 dB. Thus, for a sound source measuring 90 dB at a distance of 10 feet, the level observed
at 20 feet would be 84 dB, at 40 feet 78 dB, at 80 feet 72 dB and so on.
The distance from the subject building to its eastern property line is approximately 200 feet, representing a change in
level of about 30 dB. Diagonally to the NE comer of the parking lot measures 215 feet, roughly the same in sound level
loss. This is shown by the predicted levels in both Figures 1 and 2.
Figure 3 below shows the actual measured sound levels at four locations; inside the structure (test signal on), outside
the East entrance (test signal on), ambient noise level at Midnight in the NE comer of the parking lot (test signal on)
and ambient noise level recorded in front of the residence at 661 NE 83rd Street (test signal on).
Comparing the measured sound levels with the test signal on at the two distant locations, please note that the predicted
level for the test signal at each location is lower than the measured ambient noise levels. This would indicate that the
program material played inside the structure would be inaudible given the natural ambient noise experienced at these
two locations. Traffic noise along 82nd Street has a significant impact on the neighborhood noise floor (ambient level)
as noted in the difference (5.36 dB) between the 82nd Street (62.88 dB SPL) and 83rd Street (57.52 dB SPL) sound
levels.
Furthermore, the measured ambient noise level at 821'd Street (62.88 dB SPL) is 13 dB above the sound level of our test
signal predicted in the computer model (48.6 dB SPL) at that location. This difference in sound level represents a
subjective difference equal to a perceived "half as loud" as the ambient noise for the program material. This makes a
very convincing case for the argument that, under the conditions present the night of the tests, music played at very high
levels within the structure under examination would not be audible at the East property line adjacent to the residential

Important to the discussion is the fact that sound levels generated during the tests were unrealistically high compared
to those envisioned for the proposed facility. As a supper club / lounge, music levels of 100 dB SPL would render
conversation extremely difficult if not impossible within the space. I would foresee music sound levels not exceeding
85 dB SPL as more appropriate to the facility. You will note that we have had several discussions about designing a
suitable sound system for the property and that you are in agreement with these figures.
As applied to the test data discussed above, reducing the interior sound levels from 100 dB to 85 dB would result in
corresponding reductions in all the data presented. Sound levels at the East entrance would drop from 85 dB to 70 dB,
and predicted sound levels would likewise drop by 15 dB. This would further ensure that music from within the facility
would not be audible at any of the adjacent residential properties.
Finally, architectural drawings provided by architect Dan Robertson of HR Design indicate that a foyer is to be installed
at the East entry way. This will provide a "sound lock," much like an air lock on the Space Shuttle, that will introduce
a significant degree of sound transmission loss not present during our tests. Typical sound level reductions with such
barriers can be between 20 and 30 dB depending on the type of construction. This will further ensure that sound will

not escape the building. Indeed, it's likely that music will be inaudible outside the East entrance when the door is
closed and just barely audible when the door is open for short periods of time for patrons to gain access to or leave the
building. Certainly, never would it approach the benchmark of being "plainly audible at 100 feet" as stipulated in the
Noise Ordinance.
In summary, the proposed super club / lounge will have no negative impact on the neighborhood nor will it generate
any violation of the City of Miami's Noise Ordinance. I hope this report brings clarity to the situation and I welcome
any questions you may have.

A Guide To Acoustical
Terms and Definitions
Sound Pressure Level (SPL) = The RMS sound pressure expressed in dB re 20 microPa, the lowest
threshold of hearing for 1 kHz for a healthy auditory system. [As points of reference, 0 dB-SPL equals the
threshold of hearing, while 140 dB-SPL equals irreparable hearing damage.] See: inverse square law
below. 1 Pascal = 94 dB SPL. Average face-to-face conversation equals approximately 65 dB SPL.
Decibel (dB) = means of expressing power ratios, i.e. the difference between two sound levels, or an
absolute sound level expressed in Sound Pressure Level (SPL) referenced to a standard pressure, i.e. 94
dB SPL = 1 Pascal.
dBA = "A" weighted sound pressure level. Please refer to the attached discussion of weighting filters and
their applications.
SLM = Sound Level Meter. Device used to measure sound pressure levels.
Lmin = Lowest, or softest, Sound Pressure Level measured during the test period.
Lmax = Highest, or loudest, Sound Pressure Level measured during the test period.
Ley = Equivalent continuous sound level. The steady level which would produce the same sound energy
over the test period as the specified time -varying sound. This figure is useful for studying long-term trends
in environmental noise. A single Leg number is often used to define an entire measurement period.
L10 = Sound level exceeded 10% of the measurement period. Highest of the Ln figures.
L50 = Sound level exceeded 50% of the measurement period. Median of the Ln figures.
L90 = Sound level exceeded 90% of the measurement period. Lowest of the Ln figures. This figure is
most commonly used in estimating true ambient noise level.
Lmean = Mathematically averaged Sound Pressure Level.
NC = Noise Criteria, a standardized method of characterizing noise loudness. Extensively used in the
analysis of noise and vibration.
Sone = a subjective unit of loudness for an average listener equal to the loudness of a 1 kHz. sound that
has an intensity 40 decibels above the listener's own threshold of hearing.
Phon = the unit of loudness on a scale beginning at zero for the faintest audible sound (0.00002 Pascals)
and corresponding to the decibel scale of sound intensity with the number of phons of a given sound being
equal to the decibels of a pure 1 kHz tone judged by the average listener to be equal in loudness to the
given sound.

Inverse Square Law = inverse square law Sound Pressure Level. Sound propagates in all directions to
form a spherical field, thus sound energy is inversely proportional to the square of the distance, i.e.,
doubling the distance quarters the sound energy (the inverse square law), so SPL is attenuated 6 dB for
each doubling of distance from the source.
Noise Reduction Coefficient (NRC) = The average of the individual sound absorption coefficients at 250,
500, 1000 and 2000 Hz, to the nearest .05.
Impact Insulation Class (IIC) = Single -number rating that indicates the amount of impact noise isolation
provided by a floor/ceiling assembly. The higher the number, the better the floor/ceiling assembly.
Sound Transmission Class (STC) = A single -number rating that indicates the sound transmission Toss of
a partition or ceiling system between adjacent closed rooms. STC Ratings are:
25 Normal speech can be understood quite clearly
30 Loud speech can be understood fairly well
35 Loud speech is audible but not intelligible
42 Loud speech is audible as a murmur
45 Must strain to hear loud speech
48 Some loud speech is barely audible

Sound Level Meter Weighting Networks
The following brief description of how the various weighting networks are used is intended to provide the reader an
understanding of the purposes for and applications of standard weighting networks found in professional sound level
meters. The information is an extract from "The New Audio Cyclopedia, Handbook for Sound Engineers", edited by
Glen Ballou. It can be found on page 21 of that reference publication.
1.16 Weighting Networks
Sound level meters come with one or more
weighting networks built in. The question confronting
the user is, "Which one should I use?" The frequency
responses of the three standard networks (A, B and C)
are shown in figure 1-16. In the simplest terms, these
different curves are designed to give readings of
sound pressure level that will correspond, at least
roughly, with human response to the sound. As we
shall see in Chapter 2 "Psycho Acoustics," the
Fletcher -Munson curves show that the human ear is
less sensitive at lower frequencies than at a frequency
of 1 kHz. This effect is greater for lower -level sounds
than for louder sounds. Therefore, it makes sense to
reduce the sensitivity of the sound level meter (chiefly
in the lower frequencies) so that its readings follow the
characteristics of the ear more closely.
The A -weighted curve of Fig. 1-16 is based on
the 40 phon Fletcher -Munson equal -loudness contour
and is to be preferred for measuring lower -level
sounds such as background noise. The B-weighted
curve is based on the 70-phon equal -loudness contour
and is suitable for measuring sounds of intermediate
level. Measurements taken with the A and B
weighting are called weighted sound levels. The C
weighting is essentially flat and is used for very loud
sounds. It is also used when sound pressure levels
are to be measured and generally when the sound
level meter feeds a signal to other instruments for
analysis.
