HomeMy WebLinkAboutPlanning AnalysisPLANNING DEPARTMENT ANALYSIS Case No. 2009- 01007sc CLOSING, VACATING, ABANDONING AND DISCONTINUING A STREET LOCATED BETWEEN NORTHTHWEST 67TH AND NORTHWEST 69TH STREETS AND BETWEEN NORTHWEST 7TH AND NORTHWEST 10TH AVENUES. Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has reviewed the proposed public right-of-way vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way. The following findings have been made: • It is found that this application was presented to the Plat and Street Committee and the tentative plat was approved with a vote seven to zero. • It is found that the roadways to be vacated are a portion of NW 68th Street and NW 7th Court located around the boundaries of the tentative plat. • It is found that the 68th street allows for access to the north side of Miami - Dade Water and Sewer property and a condition to the tentative plat requires that access be provided to the Fire -Rescue Department. • It is found that the vacation and closure of the easement will unify the site and facilitate the construction of a new affordable housing project (The Villages) already approved on September 23, 2010. • It is found that the proposed street vacation complies with Section 55-15 (c) of the Miami City Code since the proposal will not affect the core service activities. The owner/developer is proffering a community room within the project that will be available for the use of community and civic organizations. to provide services such as job training, computer skills training, and tutoring for neighborhood children, among others. Based on these findings, the Planning Department recommends the request for approval with the following condition: • Access to the "Community Room" proffered as a public benefit shall be conspicuously posted. Location directions, procedure and availability shall be clearly indicated by using signage and other appropriate means, subject to review and approval by the Planning Department.
