City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01338 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE SUPPLEMENTAL JOINT PARTICIPATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION, FOR THE CITY OF MIAMI TROLLEY PROGRAM, WITH THE CONTRIBUTION OF STATE FUNDS, IN AN AMOUNT NOT TO EXCEED $1,899,151,TRANSFERRED FROM THE MIAMI STREETCAR JOINT PARTICIPATION AGREEMENT, APPROVED PURSUANT TO RESOLUTION NO. 06-0119, ADOPTED FEBRUARY 23, 2006. WHEREAS, the City of Miami ("City") Department of Capital Improvements and Transportation is pursuing all potential sources of funds to support the Miami Trolley Program; and WHEREAS, pursuant to Resolution No. 06-0119, adopted February 23, 2006, the City Commission approved the Joint Participation Agreement ("JPA") with the Florida Department of Transportation ("State") for the City Streetcar, Capital Improvement Project No. B-71215; and WHEREAS, the Miami Streetcar Project is no longer an active project and has been supplanted by the Miami Trolley Program; and WHEREAS, the State has agreed to transfer their contribution of State funds from the Miami Streetcar JPA to the Miami Trolley Program; and WHEREAS, the State requires a Supplemental Agreement to the existing Streetcar JPA in order to modify the scope of services and budget to correspond to the different project; and WHEREAS, the original Streetcar JPA identified a State contribution of 66.3082% and an Agency contribution from the City of 33.6918% towards the project cost and these amounts are approximately $1,899,150 from the State and $984,972 from the City for a total of $2,864,122; and WHEREAS, the attached Supplemental JPA identifies the new Project Description and Detailed Project Budget for capital and related Miami Trolley project costs; and WHEREAS, the City's funding contribution will be the same as the original JPA derived from the City's share of the Transit Surtax of which twenty -percent (20%) of the annual collections provided to the City must be encumbered for transit purposes or revert back to Miami -Dade County for redistribution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized{1} to execute the Supplemental Joint Participation Agreement, in substantially the attached form, with the State, for the Miami Trolley Program, with the contribution of State funds, in an amount not to exceed $1,899,150, transferred from the Miami Streetcar Joint Participation Agreement, approved pursuant to Resolution No. 06-0119, adopted February 23, 2006. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
