HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00942 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDINGS, PURSUANT TO SECTION 18-85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI FOR CONSULTING SERVICES FOR A POLICE LIEUTENANT EXAMINATION PROCESS; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENTS ("PSA"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND THE CONSULTING FIRM THAT CURRENTLY HAS A PSA WITH THE CITY, EB JACOBS LLC, TO PROVIDE AND ADMINISTER A PROMOTIONAL EXAMINATION PROCESS FOR THE CLASSIFICATION OF POLICE LIEUTENANT FOR THE DEPARTMENT OF HUMAN RESOURCES, FOR A MAXIMUM AMOUNT OF $381,816.69, AS STATED HEREIN. WHEREAS, the City of Miami ("City") Department of Human Resources is required by the Civil Service Rules to provide promotional examination processes for the Civil Service promotional classifications in the Department of Police; and WHEREAS, the City had delays in the execution of agreements due to the City's recent financial challenges, and due to United States Department of Justice oversight of the Police Lieutenant classification under the May 1999 Federal Order; and WHEREAS, in an effort to meet the timing requirements of the promotional examination needs for development, implementation and administration, scoring and reporting, the Department of Human Resources has determined that it is not practicable and advantageous to the City to adhere to competitive bidding and therefore waive competitive bidding to provide consulting services for a Police Lieutenant examination process to the City and has presented this determination to the City Manager; and WHEREAS, the City wishes to execute an amendment to the Professional Service Agreement ("PSA") between the City and the consulting firm with existing contracts with the City, EB Jacobs LLC, for said purpose; and WHEREAS, pursuant to section 18-85, of the Code of the City of Miami, Florida, as amended (:"City Code"), the City Manager has waived competitive sealed bidding methods by making the written finding containing the reasons supporting his conclusion herOn that, in this instance, competitive City of Miami Page 1 of 3 File id: 11-00942 (Version: 1) Printed On: 11/3/2011 File Number: 11-00942 sealed bidding or competitive sealed requests for proposal are not practicable or is not advantageous to the City; and said conclusion is subject to being ratified, confirmed, and approved by the City Commission by a four -fifths (4/5ths) affirmative vote after an advertised public hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written findings, pursuant to section 18-85 of the City Code, waiving the requirements for competitive sealed bidding methods as not being practicable or advantageous to the City, for consulting services for the Police Lieutenant examination process, is ratified, approved and confirmed. Section 3. The City Manager is authorized {1} to execute an amendment to the PSA, in substantially the attached form, between the City and EB Jacobs LLC, for development, implementation and administration, scoring and reporting of promotional examinations for the civil service classification of Police Lieutenant, for the Department of Human Resources, for a term of one (1) year from the anticipated contract expiration, which extends the contract from January 10, 2012, through January 9, 2013, with fees, costs and reimbursable expenses to EB Jacobs LLC, not to exceed the maximum amount of $381,816.69, for the extension period of the PSA. The extended time period of the PSA will commence, on January 10, 2012 through January 9, 2013. These funds will be paid from monies previously allocated to all firms for these professional services in total not to exceed $381,816.69, as already approved by the City Commission pursuant to Resolution No. 05-0720, adopted December 15, 2005, no additional increase in funds from the previously approved amount by Resolution No. 05-0720, will be spent. Section 4. All other terms and conditions of the PSA, including compensation and reimbursable expenses will remain in effect. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS& JULIE O. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
