Sec. 40-61. - Definitions.

Advancement means a transfer made in accordance with this article to a classification which has a
higher salary range and for which there is no requirement that the employee must have first held status
in lower classification.
Age limit isthe established limit onage. Anapplicant will be deemed tubewithin the age limit for
examination ifthe anniversary ofhis/her birth date falls within one month ofthe date mfthe
examination.
Board when used by itself refers to the civil service board of the city.
Change in classification is achange tmmdifferent classification with nochange inpay range orachange
to a classification with a lower pay range in which the employee held no previous status. A change in
classification is based on a voluntary request or other reason not involving discipline.
Civil service shall comprise all positions of trust, skill mremployment, including all employees, whether
permanent or temporary, in the service ofthe city, except as otherwise provided by the city Charter
Classified service comprises all positions not exempted by the Charter in accordance with this article.
The Charter shall beinterpreted broadly toinclude employees infederal grant programs whenever the
director ofthe personnel management department dete,rminesthat it isfeasible toselect such
employees in accordance with the selection requirements of these rules. The classified service shall be
divided into three classes, to be designated "competitive," "noncompetitive" and "labor."
Competitive class shall include all positions and employment for which it is practicable todetermine the
merit and fitness of applicants by competitive examinations andetermined by the director of the
personnel management department.

Eligible register is a list of persons who have qualified through suitable examination for employment in
positions allocated to a specified class or to a limited number of clearly defined positions within a class.

Sec 4Q'123,'Grounds for dismissal, suspension and demotion.
(a) Generally. The following are declared to constitute a breach of duty and to be grounds for dismissal or
suspension from the classified service or grounds for demotion, though charges may be based upon

causes other than those enumerated; viz, that any employee has been guilty of conduct unbecoming
any employee mfthe city who:
Has been convicted of a felony, or of a misdemeanor or offense against the dignity of the city;
Has been guilty of misuse of sick leave privilege nrexcessive tardiness orabsenteeism without good
Has willfully, wantonly, mr through culpable negligence been guilty of brutality or cruelty tmaninmate or
prisoner of a city institution or to a person in custody;

Has violated any lawful and reasonable official regulation or order, or failed to obey any lawful or
reasonable direction made and givenbyhis/hersupehar, where such violation or failure toobey
amounts to:
a.
Anact mfinsubordination; or
b.
A serious breach of proper discipline; or
C.
Resulted, or reasonably might be expected to result, in loss or injury to the city or to the public ortnthe
prisoners or wards of the city;

Has been under the influence of alcoholic beverages, onduty oroff, his/her conduct while under said
influence bringing reproach upon the city; or has been under the influence of drugs,narcotics
barbiturates or central nervous system stimulants as.defined in F.S. ch. 893 onduty mroff, his/her
conduct while under said influence bringing reproach upon the city;

Has contracted a venereal disease and refuses to.seehtreatment therefor, or physical ailment or
defect, which incapacitates the employee for properly performing the duties of the position held;
