AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING ORDINANCE NO.13114, THE MIAMI 21 CODE, THE ZONING
ORDNANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY AMENDING
ARTICLE 1. DEFINITIONS, TO CHANGE THE TERM LARGE SCALE RETAIL TO
LARGE SCALE COMMERCIAL AND ARTICLE 6. SECTION 6.3.1, LARGE SCALE
RETAIL, TO CLARIFY PROCEDURES AND MODIFY REQUIREMENTS FOR
LARGE SCALE COMMERCIAL ESTABLISHMENTS; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning, Zoning and Appeals Board, at its meeting on September 1,
2010, following an advertised public hearing, adopted Resolution No. PZAB-R-10-027 by a vote of
seven to zero (7-0), item no. 7, recommending APPROVAL to the City of Miami City Commission; and
WHEREAS, on October 22, 2009, the City Commission adopted the Miami 21 Code ("Code"),
Ord. 13114; and
WHEREAS, it has been determined that certain articles of the Miami 21 Code should be
amended to allow or restrict certain uses and provide clarification of specific articles of the Code
to better meet the needs of the residents of Miami; and
WHEREAS, the City Commission, after careful consideration of this matter deems it
advisable and in the best interest of the general welfare of the City of Miami and its citizens to
amend the Miami 21 Code, the Zoning Ordinance as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Ordinance 13114, the Zoning Ordinance of the City of Miami, Florida, is hereby
amended by making modifications to Article 1 and Article 6 in the following particulars {1}:
"ARTICLE 1. DEFINITIONS
*
Large Scale Retail Commercial: A retail or wholecalo commercial business occupying more than
55,000 square feet of Floor Area with a regional market area, including but not limited to retail or
wholesale sales, membership warehouse clubs, discount stores and department stores. See Article 6.

ARTICLE 6. SUPPLEMENTAL REGULATIONS
6.3.1 Large Scale Retail -Commercial
Any single retail commercial establishment occupying more than 55,000 square feet of Floor
Area in any T6-O, D1 or D2 shall be permitted subject to the following requirements: exceeding
the sizes and conditions of the Transect in which it is located shall be the subject to the
requirements of a Special Area Plan.
Large Scale Retail Commercial
Rental Area Limitations: Minimum: 55,000 square feet
Maximum: 100,000 square feet

Section 3. If any section, part of a section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. It is the intention of the City Commission that the provisions of this Ordinance
shall become and be made a part of the Miami 21 Code of the City of Miami, Florida, which
provisions may be renumbered or reentered and that the word "ordinance" may be changed to
"section", "article", or other appropriate word to accomplish such intention.
Section 5. This Ordinance shall become effective upon its adoption and signature of the
Mayor. (2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
