HomeMy WebLinkAboutR-10-0537City of Miami Legislation Resolution: R-10-0537 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01334 Final Action Date: 12/16/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT FOUR TO THE FISCAL YEAR 2005 COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") DISASTER RELIEF INITIATIVE CONTRACT BETWEEN MIAMI- DADE COUNTY AND THE CITY OF MIAMI, IN SUBSTANTIALLY THE ATTACHED FORM, AUTHORIZING THE EXTENSION OF THE CONTRACT FROM JUNE 30, 2010 TO JUNE 30, 2011, FOR THE PURPOSE OF PROVIDING CDBG FUNDS, IN THE AMOUNT OF $2,000,000, FOR THE REHABILITATION OF MULTI -FAMILY PROPERTIES THAT SUFFERED HURRICANE DAMAGE UNDER THE MILITARY CONSTRUCTION APPROPRIATIONS AND EMERGENCY HURRICANE SUPPLEMENTAL APPROPRIATIONS ACT, A/K/A DISASTER RECOVERY PROGRAM, FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR SAID PURPOSE. WHEREAS, pursuant to the Military Construction Appropriations and Emergency Hurricane Supplemental Appropriations Act, Community Development Block Grant ("CDBG") disaster relief funding was made available to the State of Florida by the United States Department of Housing and Urban Development; and WHEREAS, Miami -Dade County ("County") was allocated the amount of $16,000,000, to be shared by all municipalities in the County based on need and the project; and WHEREAS, pursuant to Resolution No. 07-0131, adopted March 8, 2007, the Miami City Commission gave the City Manager the authority to accept a CDBG grant award in the amount of $2,000,000 from the County, for the City of Miami's ("City") Disaster Recovery Program; and WHEREAS, said funds will be utilized to provide rehabilitation assistance to ten multi -family properties that were damaged due to the hurricanes; and WHEREAS, on September 11, 2007, the Fiscal Year ("FY") 2005 CDBG Disaster Relief Initiative ("DRI") contract between the City and the County was executed for the purpose of providing CDBG funds for the rehabilitation of the multi -family properties with an expiration date of June 30, 2008; and WHEREAS, on September 6, 2008, the City and the County executed an amendment extending the FY 2005 CDBG DRI contract date from June 30, 2008 to December 31, 2008; and WHEREAS, pursuant to Resolution No. 09-0216, adopted May 14, 2009, the Miami City Commission gave the City Manager authority to execute an additional amendment to the FY 2005 CDBG DRI contract, granting an extension from June 30, 2008 to December 31, 2009; and City of Miami Page 1 of 2 File Id: 10-01334 (Version: 1) Printed On: 8/16/2017 File Number: 10-01334 Enactment Number: R-10-0537 WHEREAS, pursuant to Resolution No. 10-0086, adopted February 25, 2010, Miami City Commission gave the City Manager authority to execute an additional amendment to the FY 2005 CDBG DRI contract, granting an extension from December 31, 2009 to June 30, 2010; and WHEREAS, 121 units of housing have been assisted and three (3) additional properties, with a total of 227 units of housing, are currently waiting to be rehabilitated; and WHEREAS, the Administration recommends the approval of an extension to the FY 2005 CDBG DRI contract between the County and the City for the City's Disaster Recovery Program from June 30, 2010 to June 30, 2011, and the authorization of the City Manager to execute Amendment Four to the FY 2005 CDBG DRI contract for the extension of the $2,000,000 CDBG grant award, in substantially the attached form; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute Amendment Four to the FY 2005 CDBG DRI contract between the County and the City, in substantially the attached form, authorizing the extension of the contract from June 30, 2010 to June 30, 2011, for the purpose of providing CDBG funds, in the amount of $2,000,000, for the rehabilitation of multi -family properties that suffered hurricane damage under the Military Construction Appropriations and Emergency Hurricane Supplemental Appropriations Act, a/k/a Disaster Recovery Program, from the United States Department of Housing and Urban Development for said purpose. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
