Burgess County Manager Resolution Authorizing a Memorandum of Understanding with the City of Miami for demolition of the Elizabeth Virrick II public housing development. Recommendation It is recommended that the Board of County Commissioners (Board) approve and authorize the County Mayor or the County Mayor's designee to execute a Memorandum of Understanding (MOU) with the City of Miami (City) for the demolition of the Elizabeth Virrick II public housing development managed by the Miami -Dade Public Housing Agency (MDPHA). SCOPE The existing dilapidated and unsafe structures at Elizabeth Virrick II public housing development consisting of 57 units, have been approved for demolition by the United States Department of Housing and Urban Development (HUD) and the Board of County Commission pursuant to Resolution No. R-.998-05, as amended by Resolution No. R-26-10. The City of Miami will procure a contractor to conduct asbestos abatement and demolition of the structures. FISCAL IMPACT/FUNDING SOURCE The City of Miami will provide funding through its allocation of Neighborhood Stabilization Program (NSP) funds, for the asbestos abatement, and demolition of the Elizabeth Virrick II public housing development. TRACK RECORD/MONITOR The MOU between the County and City establishes the responsibilities, project management, indemnification, insurance, termination/remedies, record retention/ownership, standards of compliance, relationship between the parties, and general provisions. The City of Miami Community Development Division, as the project manager, is responsible for overall coordination and oversight relating to the performance of the abatement, and demolition work under the MOU. BACKGROUND The Elizabeth Virrick II public housing development was originally constructed in 1968. The buildings are vacant, dilapidated, boarded up, and unsafe. Both, the City of Miami and Miami -Dade County, desire to demolish the existing buildings. On September 8, 2005 the Board approved R- 998-05 authorizing the County to submit a demolition/disposition application for the Elizabeth Virrick I and 11 public housing developments to HUD. On January 21, 2010, the Board amended its earlier resolution with the adoption of Resolution No. R-26-10, which authorized the County to remove the disposition component as well as the requirement that the site be leased to MDHA Development Corporation. The Board also authorized the County to change the development approach for Elizabeth Virrick II to design -build and revise the number of units from up to 196 elderly units to approximately 124. This site is scheduled to be redeveloped by Miami -Dade County using GOB funds, when these become available. Subsequent to the Board's adoption of Resolution No. R-26-10, the City of Miami contacted MDPHA to offer their services through their Community Development Division, which has available NSP funds. The City's proposal is to use their NSP funds, at no cost to the County, for the demolition of Elizabeth Virrick II. The City has also agreed to abate and remove the asbestos from the site. The County cannot use its available NSP funds for projects outside its jurisdiction, and within the limits of another jurisdiction, such as the City of Miami; therefore demolition of these dilapidated units using the City's NSP funds is beneficial to both, City and County. Accordingly, the City and the County desire to enter into a MOU to facilitate the demolition of Elizabeth Verrick II. Howard Piper Special Assistant
