HomeMy WebLinkAboutLegislationCity of Miami Legis!ation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01351 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO ACCEPT, PURSUANT TO A SPECIAL WARRANTY DEED , THE DONATION OF THE PARCEL OF LAND LOCATED AT 1492 NORTHWEST 62ND STREET, MIAMI, FLORIDA, FOLIO NO. 01-3114-035-1690, FROM CARRFOUR SUPPORTIVE HOUSING, INC.; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS , IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, on December 17, 2009, Carrfour Supportive Housing , Inc. ("Carrfour") requested to have Ordinance No. 10544 amended by designating a land use and zoning change of the property located at approximately 1421 Northwest 61 st Street, Miami, Florida, from the Department of Parks and Recreation, to a medium density multi -family residential for the construction of affordable housing; and WHEREAS, on April 8, 2010, the Miami City Commission approved amending said ordinance to change the land use and zoning change for said parcel; and WHEREAS, the approval of the land -use and zoning was predicated on Carrfour voluntarily proffering to purchase and donate the vacant parcel bearing Folio/Parcel ID Number 01-3114-035- 1690, located at 1492 Northwest 62nd Street, Miami, Florida, ("Property") to the City of Miami ("City") for future expansion of the African Square Park, located in the City; and WHEREAS, on September 21, 2010, Carrfour informed the City that they are in possession of the Property and ready to donate the Property to the City for the expansion of African Square Park; and WHEREAS, the Administration recommends the acceptance of the donation of the Property located at 1492 Northwest 62nd Street, Miami, Florida from Carrfour; and WHEREAS, Carrfour will convey the Property by Special Warranty Deed, in a form acceptable to the City Manager and City Attorney; and WHEREAS, Carrfour will provide, at its own cost, an American Land Title Association (ALTA) Owner's Policy of Title Insurance ,with Florida Modifications, in a form acceptable to the City Manager and City Attorney, for the Property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The donation of the Property by Special Warranty Deed from Carrfour as grantor to the City as grantee, in a form acceptable to the City Manager and City Attorney, is accepted. Section 3.. The City Manager is authorized.{1.} to execute any necessary documents incidental to this donation for said purpose. Section 4 This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESe.- JULIE BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution,. it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
