HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01395 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A REIMBURSEMENT GRANT FOR THE TERM BEGINNING NOVEMBER 1, 2010 THROUGH OCTOBER 31, 2011 IN THE AMOUNT OF NOT TO EXCEED EIGHT HUNDRED AND NINETY-NINE THOUSAND, TWO HUNDRED AND SIXTY-NINE DOLLARS AND SEVENTY-EIGHT CENTS ($899,269.78) ("SCHOOL YEAR 2010-2011 GRANT") FROM THE CHILDREN'S TRUST (THE "TRUST") AND TO PROVIDE A CITY OF MIAMI ("CITY") IN -KIND MATCH OF NOT TO EXCEED TEN THOUSAND DOLLARS ($10,000) FOR THE SERVICE PARTNERSHIPS PROGRAM TO THE CITY FOR THE CONTINUATION AND EXPANSION OF THE CITY'S TRUANCY REDUCTION SERVICE PARTNERSHIP PROGRAM DURING THE 2010-2011 SCHOOL YEAR (THE "PROGRAM"); AUTHORIZING CREATION OF, ACCEPTANCE OF THE SCHOOL YEAR 2010-2011 GRANT FUNDING INTO, AND APPROPRIATION FROM A NEW SPECIAL REVENUE FUND ENTITLED: "THE CHILDREN'S TRUST SERVICE PARTNERSHIP GRANT SCHOOL YEAR 2010-2011," TO FUND THE PROGRAM BY APPROPRIATING FUNDS, IN THE AMOUNT OF NOT TO EXCEED EIGHT HUNDRED AND NINETY-NINE THOUSAND, TWO HUNDRED AND SIXTY-NINE DOLLARS AND SEVENTY-EIGHT CENTS ($899,269.78) FROM THE SCHOOL YEAR 2010-2011 GRANT AND APPROPRIATING THE CITY'S IN -KIND MATCH IN AN AMOUNT NOT TO EXCEED TEN THOUSAND DOLLARS ($10,000); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY., A FISCAL YEAR 2010-2011 CONTRACT WITH THE TRUST (THE "TRUST CONTRACT"), FOR SAID PURPOSES, AND TO NEGOTIATE AND TO EXECUTE ALL OTHER NECESSARY DOCUMENTS, AFTER CONSULTATION WITH THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE SCHOOL YEAR 2010-2011 GRANT AWARD FOR SAID PURPOSES; ADDITIONALLY, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY, ANY RELATED PROFESSIONAL SERVICES AGREEMENTS WITH NOT -FOR -PROFIT SERVICE PROVIDERS AND INTERLOCAL AGREEMENTS WITH MIAMI-DADE COUNTY PUBLIC SCHOOLS AND WITH THE 11TH JUDICIAL CIRCUIT COURT, ALL IN COMPLIANCE WITH THE TRUST CONTRACT, FOR A PERIOD COMMENCING NOVEMBER 1, 2010 THROUGH OCTOBER 31, 2011, AS NECESSARY UNDER THE SCHOOL YEAR 2010-2011 GRANT; ADDITIONALLY AUTHORIZING THE CITY MANAGER, AFTER CONSULTATION WITH THE CITY ATTORNEY TO NEGOTIATE AND TO EXECUTE ANY EXTENSIONS TO THE TRUST CONTRACT, THE PROFESSIONAL SERVICES AGREEMENTS, AND THE INTERLOCAL AGREEMENTS FOR A SIMILAR SCHOOL YEAR PERIOD FOR THE SAME AMOUNTS AND THE SAME TERMS AND CONDITIONS. City of Miami Page 1 of 3 File Id: 10-01395 (Version: 11 Printed On: 12/3/2010 File Number: 10-01395 WHEREAS, the City of Miami (the "City") has been awarded by The Children's Trust (the "Trust") a continuation reimbursement grant for the 2010-2011 School Year commencing November 1, 2010 through October 31, 2011, in the amount of not to exceed Eight Hundred and Ninety -Nine Thousand, Two Hundred and Sixty -Nine Dollars and Seventy -Eight Cents ($899,269.78) (the "School Year 2010- 2011 Grant") and is required to provide an in -kind match by the City in an amount not to exceed Ten Thousand Dollars ($10,000) for the City's Truancy Reduction Service Partnership Program (the "Program"); and WHEREAS, it is in the best interests of the City for the City Commission to authorize the City Manager to negotiate and to execute the final award package for the Program, including a reimbursement grant contract with the Trust, to accept the School Year 2010-2011 Grant; and WHEREAS, the Program is comprised of a cooperative effort between the City, Miami -Dade County Public Schools, the 11th Judicial Circuit Court, and several community -based organizations for its successful implementation; and WHEREAS, the goals of the Program are to join efforts to connect the home, school and community to ensure that children acquire the necessary skills for success in their adult life, so that they are able to compete in a global economy; and WHEREAS, the City must execute an award package, including a new form of Trust contract (the "Trust Contract"), to accept the School Year 2010-2011 Grant and in order to enter into any related professional services agreements with not -for -profit service providers and the related interlocal agreements with Miami -Dade County Public Schools and the 11 th Judicial Circuit Court in order to comply with the Trust's requirements; and WHEREAS, it is in the best interests of the City for the City Commission also to authorize the City Manager to negotiate and to execute, subject to review with the City Attorney, any extensions/amendments authorized by the Trust for the Program under the Trust Contract, the related professional services agreements with not -for -profit services providers and the related interlocal agreements with the Miami -Dade County Public Schools and the 11th Judicial Circuit Court; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to accept a reimbursement grant for the term beginning November 1, 2010 through October 31, 2011 in the amount of not to exceed Eight Hundred and Ninety -Nine Thousand, Two Hundred and Sixty -Nine Dollars and Seventy -Eight Cents ($899,269.78) ("School Year 2010-2011 Grant") from The Children's Trust (the "Trust") and to provide a City in -kind match of not to exceed Ten Thousand Dollars ($10,000) for the Service Partnerships Program to the City for continuation and expansion of the City's Truancy Reduction Service Partnership Program during the 2010-2011 School Year ( the "Program"). Section 3. Authorizing the creation of a new Special Revenue Fund entitled "The Children's Trust Service Partnership Grant School Year 2010-2011", acceptance of the School Year 2010-2011 Grant funding, and appropriation from the new special revenue fund as follows: City ofMiami Page 2 of3 File Id: 10-01395 (Version: 1) Printed On: 12/3/2010 File Number: 10-01395 FUND TITLE: The Children's Trust Service Partnership Grant School Year 2010-2011 $899,269.78 RESOURCES:; City's In -Kind Match $ 10,000.00 APPROPRIATIONS: $909,269.78 Section 4. The City Manager is further authorized to negotiate and to execute, after consultation with the City Attorney, a Fiscal Year 2010-2011 Contract with the Trust (the "Trust Contract") for said purposes and to negotiate and to execute all other necessary documents, after consultation with the City Attorney, to implement the acceptance of and compliance with the School Year 2010-2011 Grant award for said purposes. Section 5. Additionally, the City Manager is authorized to negotiate and to execute, after consultation with the City Attorney, any related professional services agreements with not -for -profit service providers and interlocal agreements with Miami -Dade Public Schools and with the 11th Judicial Circuit Court, all in compliance with the Trust Contract for a period commencing November 1, 2010 through October 31, 2011, as necessary under the School Year 2010-2011 Grant. Section 6. Additionally, the City Manager is authorized to negotiate and to execute, after consultation with the City Attorney, any extensions to the Trust Contract, the professional services agreements and the interlocal agreements, for a similar school year period for the same amounts and the same terms and conditions. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY (66( Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
