HomeMy WebLinkAboutLegislation (Version 3) 12-16-10City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL. 33133 www.miamigov.com File Number: 10-01234 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING THE FINDINGS OF THE EVALUATION COMMITTEE, PURSUANT TO REQUEST FOR PROPOSALS ("RFP") NO. 207193, FOR CLAIMS ADMINISTRATION AND MANAGED CARE SERVICES; AUTHORIZING THE CITY MANAGER, TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT ("PSA"), IN SUBSTANTIALLY THE ATTACHED FORM, AND IN ACCORDANCE WITH THE ATTACHED TERM SHEET, WITH GALLAGHER BASSETT SERVICES, INC., FOR THE PROVISION OF CLAIMS ADMINISTRATION SERVICES AND MANAGED CARE SERVICES PART I: WORKERS COMPENSATION CLAIMS ADMINISTRATION, PART II: GENERAL, AUTOMOBILE, AND PROFESSIONAL LIABILITY CLAIMS ADMINISTRATION, AND PART III: MANAGED CARE SERVICES, FOR THE DEPARTMENT OF RISK MANAGEMENT, FOR A PERIOD OF THREE (3) YEARS, WITH OPTIONS TO RENEW FOR FIVE (5) ADDITIONAL ONE-YEAR PERIODS; WITH THE NEGOTIATED PSA BEING BROUGHT BEFORE THE CITY COMMISSION FOR ITS REVIEW AND APPROVAL PRIOR TO EXECUTION BY THE CITY MANAGER; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS OF THE USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL. WHEREAS, on April 13, 2010, Request for Proposals ("RFP") No. 207193 for Claims Administration Services and Managed Care Services was issued and eight (8) proposals were received, two (2) were deemed non -responsive for Part I, II, and III and two (2) were deemed non -responsive for Part III only; and WHEREAS, Section 3.1. of the RFP, indicates that the City of Miami ("City") reserves the right to award Part, I, and/or Part II, and/or Part III services to a Successful Proposer; and WHEREAS, the Evaluation Committee, appointed by the City Manager, recommended that the City enter into negotiations with Gallagher Bassett Services, Inc. for Part I, Part II, and Part III, and should contract negotiations fail with Gallagher Bassett Services, Inc. for all three parts, the City should then enter into negotiations with Gallagher Bassett Services, Inc. for Parts I and II and with Amerisys for Part III, and should negotiations fail with Gallagher Bassett Services, Inc. and Amerisys, the City should then enter into negotiations with PGCS for Part I, with York Risk Services Group, Inc., for Part II, and with Amerisys for Part III Services; and WHEREAS, the City Manager concurred with the findings of the Evaluation Committee; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 10-01234 (Version: 3) Printed On: 12/6/2010 Fite Number: 10-01234 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Therecommendation of the of the City Manager approving the findings of the Evaluation Committee pursuant to RFP No. 207193, to accept the proposal of Gallagher Bassett Services, Inc. for the provision of Claims Administration Services and Managed Care Services (Part I: Workers Compensation Claims Administration, Part II: General, Automobile and Professional Liability Claims Administration, and Part III: Managed Care Services), is accepted. Section 3. The City Manager is authorized {1} to negotiate and execute a Professional Services Agreement ("PSA"), in substantially the attached form, and in accordance with the attached term sheet ,with Gallagher Bassett Services, Inc. for Part I, Part II, and Part III, Claims Administration and Managed Care Services for a period of three (3) years, with options to renew for five (5) additional one-year periods, with funds allocated from the various sources of funds of the user departments. The negotiated PSA will be brought before the City Commission for its review and approval prior to execution by the City Manager. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
