HomeMy WebLinkAboutR-10-0568City of Miami Legislation Resolution: R-10-0568 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01442 Final Action Date: 12/16/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION REQUIRING, AS A CONDITION FOR THE USE OF ANY CITY OF MIAMI VENUE, FOR PUBLIC PERFORMANCES, CLINCS, WORKSHOPS, ATHLETIC AND OTHER COMPETITIONS, AND EXHIBITIONS, BY ANY NATIONAL SUBJECT TO RESTRICTIONS IMPOSED BY THE UNITED STATES DEPARTMENT OF TREASURY, THE SUBMISSION TO THE CITY OF MIAMI OF EVIDENCE OF THE EXISTENCE OF THE ISSUANCE OF THE SPECIFIC LICENSE ISSUED BY THE U.S. DEPARTMENT OF TREASURY FOR SAID PUBLIC PERFORMANCE, CLINIC, WORKSHOP, ATHLETIC AND OTHER COMPETITION, AND/OR EXHIBITION. WHEREAS, the United States Department of Treasury regulates transactions involving designated foreign countries or their nationals [see, e.g., 31 C.F.R. s. 515.201]; and WHEREAS, the United States Department of Treasury authorizes the issuance of specific licenses, on a case -by -case basis, authorizing transactions incident to participation in public performances, clinics, workshops, athletic and other competitions, and exhibitions in the United State by said nationals who enter the United States for the purpose of such participation on a visa or other travel authorization issued by the Department of State [see, e.g., 31 C.F.R. s. 515.567(b)(2)]; and WHEREAS, any person violating said regulations, or any license issued thereunder, are subject, upon conviction, to fine of not more than $1,000,000, or, if an individual, of a fine not more than $100,000 or imprisonment for not more than 10 years, or both [see, e.g., 31 C.F. R. s. 515.701(a)].; and WHEREAS, City of Miami venues are available for use by any person, including said nationals, for public performances, clinics, workshops, athletic and other competitions, and exhibitions; and WHEREAS, in order to avoid an inadvertent violation of said regulations, or any license issued thereunder, by the City of Miami, or any of its officials, officers, agents or employees, any person subject to said regulations, wishing to use a City of Miami venue, shall, as a condition to the use of said venue, provide the City of Miami with evidence of the existence of the issuance of the specific license issued by the U.S. Department of Treasury for the public performance, clinic, workshop, athletic and other competition, and/or exhibition said national wishes to use the venue for; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commision requires as a use of any City of Miami venues for public City of Miami Page 1 of 2 File Id: 10-01442 (Version: 1) Printed On: 8/17/2017 File Number: 10-01442 Enactment Number: R-10-0568 performances, clinics, workshops, athletic and other competitions, and exhibitions, by persons or entities subject to the restrictions imposed by regulation of the United States Department of Treasury, to be conditioned upon the presentation of evidence to the City of Miami of the existence of the issuance of the specific license issued by the United States Department of Treasury for the public performance, clinic, workshop, athletic and other competition, and/or exhibition said national wishes to use the venue for. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
