HomeMy WebLinkAboutO-13231City of Miami Legislation Ordinance: 13231 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01255 Final Action Date: 11/18/2010 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 57/ARTICLE III OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED: "VEHICLES FOR HIRE/PEDICABS FOR HIRE," MORE PARTICULARLY BY CREATING A NEW SECTION 57-46, TO ESTABLISH A PROCESS FOR AMENDING REGULATIONS FOR PEDICABS ON THE PUBLIC STREETS AND SIDEWALKS IN THE CITY OF MIAMI DURING SPECIAL EVENTS; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, the City of Miami ("City") has adopted regulations governing the operation of nonmotorized vehicles, more specifically, pedicabs, on public streets; and WHEREAS, pedicabs benefit the environment by using no fossil fuels and decreasing traffic on public streets; and WHEREAS, the City's economy, and in turn, its citizens, benefit from special events, as they serve to entertain and educate both citizens and visitors; and WHEREAS, any given special event can bring thousands or more visitors to the City; and WHEREAS, the City deems it to be in the best interest of its citizens and the general public to create a process whereby the regulations governing the operation of pedicabs are relaxed for special events, while still protecting the public health, safety, and welfare; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 57/Article III of the Code of the City of Miami, Florida, entitled "Vehicles for Hire/Pedicabs for Hire", is amended in the following particulars: {1} "CHAPTER 57 VEHICLES FOR HIRE ARTICLE III. PEDICABS FOR HIRE 57-46. Special Events Operation. City of Miami Page 1 of 3 File Id: 10-01255 (Version: 3) Printed On: 8/14/2017 File Number: 10-01255 Enactment Number: 13231 (1) The city commission may, by resolution, designate a particular event taking place in the city as a special event. During a special event period, which shall not be longer than fifteen (15) days, Pedicab owners within the particular area described in the resolution shall be subject to all of the requirements set forth in the code for Pedicab operations, except as follows: a. All Pedicab drivers are required to have on their person a current Driver's License issued by any state within the United State of America. b. Proposed routes must be approved in writing by the public works director or designee. If the proposed route is within the boundaries of the particular area described in the resolution, and the public works director or designee fails to approve the proposed route within five (5) business days following receipt, the route shall be deemed approved. c. Any applicant wishing to operate a Pedicab with advertising shall pay a regulatory business fee in the amount of one hundred dollars ($100.00) per Pedicab for the cost of administering the program, as well as the privilege of utilizing the streets for private advertising purposes during the special event. This fee shall be in addition to any Business Tax Receipt(s) or Decal Fees that may be required by the Finance Department for conducting any advertising activities. d. Prior to obtaining a decal the Pedicab owner shall submit a completed package with all applicable signatures to the finance department. In addition to the above, the following information must be included with the submittal: Pedicab vehicular information, Pedicab reference form provided by the finance department, copy of a current and valid Driver's License for the applicant, list of all Pedicab drivers, copy of current and valid Driver's License for each Pedicab driver, decal fee, and a drawing detailing routes. e. Each Pedicab operated within the special event area shall prominently display, in a 5-inch by 5-inch frame covered with clear plastic, a card or sign, printed in plain, legible letters and numbers which shall state whether gratuities or donations are accepted and contain the schedule of rates for the transportation services offered by the Pedicab driver; the decal number of such Pedicab; and the name and work address of both the Pedicab owner and the Pedicab driver of such pedicab. No Pedicab driver may charge a fee that is not so posted. A map showing the approved route shall also be displayed. f. Pedicabs shall be exempt from the equipment requirements contained in section 57- 36(5)(iii)-(v). g. Advertising, including wrap advertising, shall be allowed on a maximum of twenty-six (26) square feet of the Pedicab. No advertisement on a Pedicab is allowed for tobacco products or adult entertainment products or establishments. h. No one person as that word is defined in section 57-26 of this article may be the recipient of more than twenty (20) Pedicab decals at any one time. i. The city commission, by resolution, may modify the requirements set forth in this section as may be in the best interest of the city. Section 2. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/ or figures shall be added. The remaining provisions are now in effect and remain unchanged. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
