AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
57/ARTICLE III OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED:"VEHICLES FOR HIRE/PEDICABS FOR HIRE," MORE
PARTICULARLY BY CREATING A NEW SECTION 57-46, TO ESTABLISH A
PROCESS FOR AMENDING REGULATIONS FOR PEDICABS ON THE PUBLIC
STREETS AND SIDEWALKS IN THE CITY OF MIAMI DURING SPECIAL EVENTS;
CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, the City of Miami ("City") has adopted regulations governing the operation of
nonmotorized vehicles, more specifically, pedicabs, on public streets; and
WHEREAS, pedicabs benefit the environment by using no fossil fuels and decreasing traffic on
public streets; and
WHEREAS, the City's economy, and in turn, its citizens, benefit from special events, as they serve
to entertain and educate both citizens and visitors; and
WHEREAS, any given special event can bring thousands or more visitors to the City; and
WHEREAS, the City deems it to be in the best interest of its citizens and the general public to
create a process whereby the regulations governing the operation of pedicabs are relaxed for special
events, while still protecting the public health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Chapter 57/Article III of the Code of the City of Miami, Florida, entitle1hs fdc,---

The city commission may, by reeu|ution, desklna1e a particular event taking p|moo in the city as
a special event. [)uhnq a special event period, which shall not be |mnqerthan fifteen (15) days.
Pedicab owners within the particular area described in the resolution shall be subject to all of
the requirements set forth in the code for Pedicmb operoUnns, except as fuUovva:
o. All Pedioabdrivars are required to have on their person m current Oriv&o License
issued by any state within the United State of America,
b� Proposed routes must be approved in writing by the public works director ordesignee.
If the proposed route is within the boundaries of the particular area described in the
naao|u1ion, and the public works director or designee fails to approve the proposed route
within five(5) business days following receipt, the route ahoU be deemed approved.
o. Any applicant wishinq to operate a Pedicab with advertisinq shall pay a requlatory
business fee in the amount of one hundred dollars ($100.00) per Pedicab for the cost of
administering the prognanl, as well as the privi/ope of utilizing the streets for private
advertising purposes duhnqthe special event. This fee shall beinaddition toany
Business Tax Receipt(o) or Decal Fees that may be required by the Finance
Department for uonduct)nqany advertising activities.
d. Prior to obtaining a decal the Ped|oab owner shall submit a completed package with all
applicable signatures tothe finance department. In addition tothe above` the hz||ovv/nq
information must be included with the submittal: Pediombvehicular information, Pedioab
reference form pnovideJ by the finance departnnent, copy of current and valid Driver's
License for the applicant, |io1 of all Pedicab drivero, copy of current and valid [}riv&o
License for each Pedioeb driver, decal hye, and a drawing detailing routes.
e. Each Padinmb operated within the special event area shall prominently disp|ay, in a
-inch by -inch frame covered with clear p|oado, o card or oiWn, printed in
plain, legible letters and numbers which shall state whether qnotuihes or donations are
accepted and contain the schedule nfrates for the transportation services offered by
the Pedicabdriver; the decal number ofsuch Padioab�and the name and work address
of both the Pedicmb owner and the Pedioab driver of such pedicob. No Pedicab driver
may charge 3fee that isnot so posted. Amap showing the approved route shall also be
displayed.
[ Pedinabashall beexempt from the equipment requirements contained in section 57-
36(5)(iii)-M.
g. Advertising shall be allowed on a maximum of twenty-six (26) square feet of the
Ped)cob. No adVmrti8m[neO1 on @ Pedic@b is 8U0vved for tobacco products or adult
entertainment establishments.
h. No one person as that word is defined in section 57-26 of this article may be the
recipient ofmore than twenty (2U)Padioobdecals otany one time.
i The city conlrniasion, by reoo|uLion, may nnod|fythe requirements set forth in this
section as nnoy be in the beat interest of the city.
Section 2. If any aeotion, port of section, parmQrmph, deuae, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected,

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
